Licensing Program Analyst (LPA) Warren Birks conducted an unannounced complaint inspection to investigate the above allegations. LPA met with Director Katherine Lozano who provided assistance during the investigation.

During the course of the investigation, LPA conducted interviews with 15 children and eight (8) staff. LPA also made surveilled observations of care, reviewed facility staff files and education records. LPA received corroborated disclosure that at least one staff member yelled at children in a loud harsh tone as a form of discipline and/or to persuade children to follow instructions. LPA informed Director Katherine Lozano that this action is a violation of Title 22 Regulations and the facility is cited for Personal Rights.

In regards to Unqualified Staff, LPA received corroborated disclsoure that staff #4 provided childcare in a Qualified Teacher role (providing care for a classroom without supervision for approximately one month). However during the investigation, LPA discovered that staff #4 does not have Early Childhood Education

units required to conduct childcare in that capacity. LPA also received corroborated disclosure that Fingerprint Cleared Church staff provide care for children on at least one occasion for approximately 15 to 20 minutes while the facility conducted a staff meeting on site.

LPA informed Director Lozano, that only qualified Teachers (with the title of Teacher) may be alone with children (with the exception of bathroom breaks and napping. LPA informed Director that aides or teacher assistants must work under a Qualified Teacher at all times. LPA informed Director Lozano that this action is a violation of Title 22 Regulations and the facility is cited for Teacher Qualifications and Duties.

Based on interviews and file review, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

A copy of this report must be provided to the parent or guardian of every child and (including any newly enrolled children) for the next 12 months. The Acknowledgement of Receipt (LIC 9224 form must be maintained in each child’s file immediately upon receipt from parent/guardian). Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) form.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Katherine Lozano
