On 9/12/2024, Licensing Program Analyst (LPA) Jeanine Lipsey made an unannounced visit for the purpose of delivering findings regarding the above allegation. LPA met with Director Joanna Port who led LPA on a tour of the facility. LPA observed thirty four children being supervised by twelve adults in this facility. Staff disclosed nine other children are at the park with 2 staff.

Pertaining to the allegation “Facility operated beyond the terms of the license”.

Per reporting party, the facility is licensed to have 34 children in care however they are caring for 46 kids.

Staff disclosed that they operate two facilities. Facility at the park operates daily from 9am to 12pm. Today nine children and 2 staff are at the park and are due to return at noon after the 3 year old children leave at noon. LPA discovered that the park facility is inactive status as of 7/30/21.

On 9/12/2024, Licensing Program Analyst (LPA) Jeanine Lipsey made an unannounced visit for the purpose of delivering findings regarding the above allegation. LPA met with Director Joanna Port who led LPA on a tour of the facility. LPA observed forty three children being supervised by twelve staff.

Pertaining to the allegation “Facility is not conducting fire drills.

Per reporting party, the school does not conduct fire drills.

Staff stated they have regular fire drills, the last drill was conducted on July 10th, 2024, at 10am and Feb. 15th, 2024, but they do not have documentation because a former staff threw them away.

Based upon observations and evidence obtained during this investigation, the allegation of “Facility is not conducting fire drills”, have been determined to be Substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standards has been met.

Notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Joanna Port.

 Staff stated they thought the facility was reactivated in 2022 since the fees were current and did not realize that the facility needed to be reactivated.. Staff stated the park "kicked them out" in August of 2023 and they renegotiated a deal to return in January of 2024. Due to the park facility being inactive the children at the park are included in this facilities capacity, therefore the facility is over capacity from 9am to 12pm by nine children.

Per Title 22 regulations 101161 (a) A licensee shall not operate a childcare center beyond the conditions and limitations specified on the license, including the capacity limitation.

Based upon observations and evidence obtained during this investigation, the allegation of “Facility operated beyond the terms of the license” have been determined to be Substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standards has been met.

Eight 3 year old children left the facility at noon which brought the facility back into compliance. Director will stagger the children so they come in at different times, she will keep the capacity at 34 at all times..
