On 11/30/2023 Licensing Program Analysts (LPA) Judy Laureano and Ranita Richmond conducted an unannounced Annual Required Inspection at the above mentioned facility. LPAs were greeted by Laura Benavente, facility director, who guided LPAs on a tour. Facility is a combo center with an infant license on the same site; infant license number: 197407362. Present during today's inspections was M. Rodriguez, assistant director.

Facility operates Monday through Friday 7:00 a.m. to 6:00 p.m. Preschool rooms are B,C,E and F.
Facility is licensed to serve preschool children ages 2 years through 6 years of age. Preschool facility is only utilizing classroom B and C.

The following was observed:
Classroom B: 6 Children and 2 Staff members
Classroom C: 4 Children and 2 staff members
Classroom E: 9 children and 4 staff members- currently being used by the Therapeutic Preschool.
Classroom F: empty classroom- no children were observed in the space during today’s inspection.

Classrooms were observed and inspected. Classrooms were observed with age-appropriate materials and a variety of manipulative. Facility is open to enroll children that might need medication administered. Facility does not have any child that currently needs medication. All prescription and non prescription medication shall be centrally stored in accordance with the following requirements: medication shall be kept in a safe place inaccessible to the children in care, each container shall have an unaltered label.

LPAs reminded director to ensure medication is its original content with current prescription and all necessary LIC forms. LPAs observed a medication locked box in the Resource Office.

Facility has a designated cleaning staff that clean and disinfects the classrooms. Teachers are responsible for the day-to-day cleaning. Cleaning solutions were observed in locked cabinets in the classrooms. Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. LPAs observed one children’s bicycles to have a missing pedal, director removed item and will repair/replace item before children are able to use it.

LPAs observed all toilets and hand washing facilities. Floors in the facility are clean and safe. Solid waste storage containers have tight-fitting covers and are in good repair.

LPAs observed a swimming pool surrounded with an over 5ft tall gate that is self latching self closing. There are no firearms or ammunition allowed or stored on the premises.

LPAs observed working fire extinguisher and smoke detectors and carbon monoxide detector throughout the classrooms. All electrical outlets were observed to be covered.

Families bring in children’s meals and snacks in their appropriate containers; such as lunch bags with icepacks and/or thermos. All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin.

Drinking water was observed via water dispenser in each classroom. Children bring in their refillable water bottle and teachers are responsible for refilling as needed. Parent board was observed with all necessary posting. LPAs observed main parent board by the entrance of the facility and each classroom has a parent board.

The facility is free of flies, insects and rodents. Facility contracts with a Pest control vendor to ensure that facility stays pest free.

Prior to working or volunteering in a licensed childcare facility, all individuals subject to a criminal record review have received a criminal record clearance or exemption. Upon notification from the Department, the licensee will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption.

Capacity and limitations as specified on the license are being maintained.

At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. Current CPR and Pediatric First Aid was reviewed in teacher’s file. LPAs discussed the importance of making sure all Pediatric CPR and Pediatric First Aid training is EMSA approved. Mandated Reporter training was observed for all staff. LPAs reviewed a sample of children’s files and observed 6 files completed.
Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.

LPAs provided facility director an updated LIC 311A and LIC 125 to use as a reference when auditing files.

The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. LPAs observed hard copies of sign in and out sheet in front of each classroom.

All children are under supervision, including visual supervision, of a teacher at all times. Facility maintains a ratio of one teacher supervising no more than 12 children in care.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for
drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.
For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. LPAs referred facility director to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Facility director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the director Laura Benavente.
