On 05/03/2022 at 11:47 AM, Licensing Program Analyst (LPA) Monique Ayala conducted an unannounced inspection at the facility noted above and met with Director, Cynthia Sanders. The purpose of the inspection was to deliver the complaint investigation findings for the allegations noted above.

During the course of investigating the allegations, LPA Ayala conducted confidential interviews and record reviews. On 03/02/2022, LPA conducted a telephone interview with the complainant. On 03/03/2022, LPA conducted interviews the Facility Director, two staff, and two children at the child care center. On 03/03/2022, LPA attempted to interview five other children at the child care center; however, the children refused to be interviewed. On 03/28/2022, LPA conducted a telephone interview with one parent and attempted to interview one child however, the child was unable to communicate with LPA due to their verbal skills and ended the interview. On 04/05/2022, LPA conducted telephone interviews with six other parents.

The confidential interviews revealed that the child sustained a minor injury on the side of their lip however, the child care staff did not notice the injury due to the child wearing a face mask as a precautionary measure due to COVID-19. The confidential interviews also revealed that it is unknown how the child sustained the injury on the lip.

The confidential interviews revealed that the child sustained a separate injury by tripping on the classroom rug while the child was dancing with the other children. On 03/03/2022, LPA observed the rug, which is in good repair and did not pose as a tripping hazard. The interviews revealed that the child was attended to by staff, who cleaned the injured area, which consisted of a rug burn on the child's face. The interviews revealed that staff provided adequate care and supervision. The interviews also revealed that the parents were notified of the incident at pick-up and an "Ouch" report was provided. LPA obtained a copy of the report from the child care center. LPA also obtained a photograph of the child's injury. Facility Director stated that an Unusual/Injury Report (LIC 624) was not submitted to licensing due to the child's injury not requiring medical treatment per Title 22 regulations.

The other parents that were interviewed denied concerns regarding the care, supervision, and/or communication among the child care center. The record reviews did not corroborate with the allegations.

Although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that any Title 22 regulations were violated; therefore, the complaint allegations are unsubstantiated.

Appeal rights were provided and discussed with the Facility Director. No deficiencies were cited. An exit interview was conducted and a copy of the report was provided to the facility representative.
