Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection upon arrival LPA Lee met with Assistant Director Cindy Stansbury

During the course of this investigation LPA conducted interviews, reviewed documents, and made observations in regards to the above allegations.

The complaint alleges that the facility did not isolate a child who had a communicable disease. The complaint goes on to state that a child with hand foot and mouth disease was allowed to stay inside the classroom for about 30 minutes. The facility denied the allegation made no disclosure. During interviews, the Director and staff stated that on 06/22/23 a child in care (Child#1) was signed in by a parent after being asbent for several days. During the sign in period the parent explained to the classroom staff that Child#1 had hand foot and mouth disease but is now feeling better and can return. After the parent had dropped of Child#1 inside the classroom, the staff member inside the classroom notified the Director and asked to have Child#1's hands looked at.

After the Director observed Child#1's hands it was determined that Child#1 could not stay inside the classroom and the Child was escorted to the designated isolation area. The parent was notified by the Director to pick up Child#1 and the parent took the child home. According to the facility the Child was inside the classroom for about 20 minutes. The parent was still in the facility premise when they were contacted by the facility to pick up Child#1 according to interviews conducted with the facility staff.

During the investigation LPA Lee did review the parent handbook and observed that the facility does not have a specific policy about requiring a Doctor's note in order for a child to come back. The facility stated that the parent of Child#1 did not have a written document from a physician on 06/22/23 that confirmed that Child#1 was examined and can go back to school. Although Child#1 was inside the classroom for period of time on 06/22/23, the child was removed from the classroom and placed in the isolation area after the classroom teacher and Director examined Child#1. LPA Lee did not observe any type of policy in the parent handbook that was not followed by the facility on 06/22/23. The facility staff and Director did examine Child#1 despite the parent stating the Child was no longer sick and cleared by a Doctor to return. The Child was removed from the classroom and placed in the isolation area which was consistent with the written policies observed in the parent handbook.

The complaint also mentioned that a facility staff told a parent of a child in care that the facility does not wipe children during diaper changes. The reporting party did not specify if the lack of wiping caused some sort of rash or other issues to a child in care. During interviews the facility stated that there was no concerns from parents in care about any type of rash or skin conditions observed in their respective children.

The incident mentioned in the allegations occurred on 06/22/23. The facility is on summer break from 06/23/23 until 09/05/23. The complaint also stated that Child#1 was allowed to attend the graduation despite being ill. The facility denied this allegation. The Director and staff interviewed stated that the graduation ceremony is an event held for parents and families to attend and is not the same as a regular school day. The facility stated that Child#1 was not signed in by parents during the graduation ceremony on 06/23/23 since the child did not attend school that day. Child#1 was brought to the graduation ceremony on 06/23/23 by the parent and was not provided any care from the facility.

This department has investigated the complaint that facility did not isolate a child that has a communicable disease and did not clean day-care children during diaper changes. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are Unsubstantiated at this time.

The notice of site inspection must remain posted for a period of 30 days. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
