32 | Licensing staff interviewed staff members, reviewed staff files, and obtained the names of staff members present. Per staff interviews, it was disclosed that Staff #2 and Staff #4 began working at the facility before receiving fingerprint clearance. Additionally, Licensing staff observed 1 uncleared adult present in the classroom who was not associated to the facility. The uncleared adult and the director disclosed to LPA’s that their schedule is Monday-Friday 8:45am to 4:45pm and that they provide therapeutic services for one child. LPA's discussed clearance requirement with Director. Per Director’s statement, uncleared adult was sent to do fingerprints after Licensing staff made the initial complaint visit. LPA's observed “In Process” status for adult on 05/08/25. Per Director’s interview, in the past, staff have worked in the classroom before receiving fingerprint clearance. Director states that she believed that when an adult showed “In Process” that they were cleared to work, LPA's clarified that that information is incorrect and that individuals need to show an “Eligible Clearance” or “Eligible Exemption” prior to working at the facility. Based on LPA's record review of staff time reports and Guardian clearances, LPA's consistently observed that staff members hire dates precedes Guardian clearance associations.
The Reporting Party stated during the interview that they began working at the facility in 2024 and did not obtain fingerprint clearance until February 2025, indicating they worked at the facility without the required clearance during that period.
Based on LPA’s observation, interviews and reviewing documentation, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22, Division & Chapter) are being cited on the attached LIC 9099-D.
LPA’s informed Director Lauren Friedman that this report dated 5/19/25 documents 1 Type A citation, which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Type A citation needs to be provided to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Upon review, Licensee was cited for same violation on 12/17/2024, which is within the calendar year, making this a repeat violation incurring an immediate civil penalty which will be assessed. See LIC421IM. Additionally, facility will be issued an immediate $500 civil penalty for staff, S#2 and S#9, see LIC421BG. S#4 was previously cited a civil penalty on 12/2024.
Exit interview was conducted with Director Lauren Friedman. Appeal rights were provided and discussed. Notice of site visit was provided.
