Licensing Program Analyst (LPA) Saul Valenzuela conducted an unannounced Case Management inspection due to two incidents that were reported to the Department on 5/13/2025. LPA met with Principal Christina Ramaya who guided LPA on a tour of the facility. Census was taken.

On May 7th, 2025, an incident was self-reported to the Department via Phone by the facility who reported that Staff #1 violated Child #1 personal rights during nap time.



On May 13th, 2025, an incident was self-reported to the Department via Phone by the facility who reported that Staff #1 and Staff #2 violated Child #2 personal rights.

All reports were reported within the required 24 hours. The purpose of the inspection was to obtain additional information regarding the incidents reported to the Department. Per Principal that Staff #1 and Staff #2 are currently unavailable for interview at this time.

Regarding the incident on 5/7/2025, During interviews Principal stated that they walked into classroom during nap time, and observed Staff #1 yelling at Child #1. According to the Principal that Staff #1 was pointing at Child #1 as Staff #1 stood over the child while yelling in their native language at the child as the child was laying on their cot. Per Principal, that three children were crying on their cots during the interaction between Staff #1 and Child #1, and Staff #2 did not intervene nor comforted the crying children, due to Staff #2 working on a report.---------------------------- pg. 1 of 3 --------------------------

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Principal disclosed that they requested Staff #1 and Staff #2 to assist with the crying children, due to the yelling by Staff #1. According to the Principal , that they discussed Title 22 personal rights with Staff #1, Staff #2 immediately after the incident. Then principal met with entire classroom staff the following day on 5/8/2025 to discuss that yelling at children is not allowed. During staff interviews, six out of eleven (11) staff corroborated that they have heard Staff #1 use a firm voice or yell at children, and that Staff #1 voice can be heard from the classroom next door and from the hallway.

Regarding the incident on 5/13/2025, during interviews Staff #5 disclosed, Child #2 was playing outside when Child #2 observed their parent walking outside of the fence for pick up. Staff #5 disclosed that Staff #2 attempted to help Child #2 get ready for pick up time when Child #2 started to resist. Per Principal that parent disclosed that Staff #2 was holding child by the right arm to pull them up from the ground due to the child resisting. Staff #5 disclosed that Staff #2 stated to Staff #5 to help them pick up the child from the ground. According to Staff #4 and Staff #5 that parent of Child #2 stated to Staff #2 and Staff #5 to leave their child there as they would come and grab the child from the playground. Staff #4 and #5 stated that they observed Staff #1 pick up child under the armpits and took the child into the office. According to Staff #5 that they observed the child was crying when they were picked up by Staff #1. Principal stated they heard yelling outside of their office in the hallway. When they went to check they observed Staff #1 and Child #2 parent in the hallway. Per Principal they spoke with Child #2 parent outside of the office. According to the Principal that parent stated they observed their child crying on the floor with Staff #1 after they told staff to leave child in the playground area. This is an immediate risk for the health and safety of children.

Based on the LPA’s observations, record reviews and interviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

LPA Saul Valenzuela informed facility representative Christina Ramaya that this report dated 5/20/25 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Saul Valenzuela informed the licensee to provide a copy of this licensing report dated 5/20/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Principal will conduct a staff meeting reviewing personal rights video. Declarations from staff on what they learned will be submitted. Meeting minutes with signatures will be send to LPA by POC date.
