32 | At approximately 2:55 p.m. LPA entered classroom Purple and observed 11 children free playing with 2 staff members. LPA tested the classroom sink and the restroom sinks (located in the classroom). The sinks are operable, and LPA observed the classroom temperature to be at 70 degrees. Classroom Purple and blue share the restroom that is located inside between both classrooms.
During the course of the investigation 6 out of 13 staff were interviewed. Per the interviews conducted it was noted that the AC stopped functioning around September 6, 2022 in the purple and blue classroom. The director acted immediately by buying fans and transferring children and staff to the Rainbow and Green classroom where the AC was functioning. Parents were called and informed about the AC being out and given the option to come and pick up their children or leave them. Staff indicated the temperature was between 75 - 80 (which is below the maximum allowed in Title 22); once it reached 80, is when children and staff were transferred. The AC was repaired on September 9, 2022 by noon time. During this visit, LPA observed the temperatures ranging from 69 to 70 degrees which meets the required temperature range per Title 22 (68-85).
Based on the 6 staff interviews, children have access to operable sinks. Even though the sink in the Blue room is non-operable the children have access to a sink in order to wash their hands, which is located in the restroom located inside the blue classroom. Therefore, the non-operable sink does not impact the children because they have access to a hand washing sink inside the classroom and in the yard. LPA also observed the staff hand washing sink to be repaired and is operable. During this inspection, LPA tested all hand washing sinks and observed the sinks functioning.
Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegations are unsubstantiated
The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
