32 | Allegation regarding- Facility playground is contaminated with asbestos. According to the RP, the facility tested the playground, and it is contaminated with asbestos. The facility has been under construction of the roof since 09/30/24 and all children were moved to two different buildings across from the construction site. Prior to construction, children were using the big playground; however, once construction started children use the small playground. Vert environmental testing and consulting services conducted an asbestos test on the children’s (small and big) playgrounds on November 30, 2024. Vert environmental provided the asbestos contamination assessment report to the facility on 12/11/24. Upon review of the report, LPA observed that the small playground did not test positive for asbestos; however, the children’s big playground tested positive for asbestos. Per the report, the “blue slide,” “little slide,” and “boat” tested positive for asbestos (pictures included). Though children are currently not using the big playground, the facility must review and follow Vert environmental recommendations for proper disposal which includes barrier tape and signage, decontamination unit, isolate affected areas, spray air misted amended water, removal, and disposal of the top layer of soil (2 inches) and retain the services of a licensed abatement contractor registered with the Division of Occupational Safety & Health (DOSH) were documented amongst other recommendations. It is the licensee’s responsibility to ensure that the facility is safe for children, employees, and visitors.
Based on records reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).
A notice of site visit was given and must remain posted for 30 days.
