32 | -Pertaining to the allegation that there are "Unqualified staff providing care and supervision to daycare children":
Per Reporting Party (RP), the staff members are aides and that the aides don't have units.
At 9:10 AM LPM and LPAs conducted staff file reviews. In reviewing the staff files, it was discovered that each of the staff have some, if not all, of the required courses missing;
According to Title 22 regulations, a fully-qualified teacher must have "Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work experience in a licensed child care center or comparable group child care program." As none of the staff have 12 units, none of the staff are fully qualified.
Based upon record review, the allegation that "Unqualified staff providing care and supervision to daycare children" has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12 Chapter 1 Article 06, Section 101216.1 “Teacher Qualifications and Duties" is being cited.
-Pertaining to the allegation that the "Facility is operating out of ratio":
According to the RP, the facility is understaffed; there are only 2 staff with 50 daycare children.
During today's inspection, a blank copy of the sign in/out sheet documented 31 children's names. According to Applicant Matsenko, two of the children listed are no longer enrolled; therefore, the number of children enrolled is 29. In addition, there are 5 staff who work at the facility. However, as it was discovered during a review of staff files that none of the staff have 12 units are are therefore not fully qualified, the above allegation has been found to be true. In order for a facility to be considered in ratio, there should be one teacher for every 12 children. To be considered a teacher, prior to employment, a teacher shall have completed...at least six post-secondary semester or equivalent quarter units...and shall complete, after employment, at least two units each semester or quarter until they achieve 12 units in early childhood education or child development.
