Licensing Program Analyst (LPA) Mireya García arrived unannounced at the facility at 2:07 p.m., and requested access to enter the facility by dialing intercom which is located on entrance gate. Intercom rang and was not answered. LPA Garcia did not observe any postings on gate with faciilty phone numbers. LPA Garcia then proceeded with contacting facility via telepone to gain access into the facility. At 2:08 p.m, Staff #8 answered and infomed LPA that the intercom is not working and informed Staff #9 to open the gate door for LPA. The purpose of this inspection is to conducting a follow up complaint investigation to deliver findings regarding the allegations listed above. LPA met with Samira Alvarez, Child Development Supervisor (CDS) who guided LPA on a tour of the facility. There were fourty-four children observed to be present at the facility during this inspection.

Information provided by the complainant alleges that Staff hit daycare child and Staff yells at daycare children.

During this investigation LPA M. García obtained a copy of Children’s roster dated 01/23/23, 01/26/23, 02/6/23, 03/01/23, 03/20/23, staff written statements from Staff #1, #3 #4, Staff #3’s qualification documentation, service repair order for gate dated 03/23/2023, pictures and video of the self-latch gate were taken, an LIC 855 written Declaration was obtained from Staff #1, and conducted interviews with child in question, Supervisor, four (4) day care staff, three (3) day care children, three (3) day care parents and LPA attempted to interview two (2) additional staff.

Pertaining to the allegation that staff hit daycare child, interviews with day care staff reveal all staff denied observing or having knowledge of any child being hit while in care. No disclosures were made by child in questioned, children and parents interviewed.

Regarding to the allegation that staff yells at daycare children interviews with all day care staff deny observing or having any knowledge of any staff yelling at day care children. No disclosures were made by child in question, children and parents interviewed.

Based on interviews conducted with child in question, five (5) day care staff, three (3) day care children and three (3) day care parents it was determined there were no witnesses to any children being hit while in care and/or staff yelling at daycare children. Based on the interviews conducted and records review, at this time there is not enough evidence to support the above allegations.

This agency has investigated the complaint alleging that Staff hit daycare child and Staff yells at daycare children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are deemed unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with facility representative Samira Alvarez.
