32 | Pertaining to the allegation of facility gate is in despair, Staff #1 disclosed that on March 13, 2023 during outside play time child #1 open the facility gate and ran out of the facility. Staff #1 observed when child grab the gate handle and open it. Staff #1 ran after child and was able to grab child outside of the gate. Staff #1 disclosed child was outside gate alone on the sidewalk by the entrance gate for less than 4 seconds. Staff #1 states, child was able to open door since self-closing latch was not working properly. Interview with Supervisor confirm incident took place at the facility.
Based on LPAs inspection of the gate LPAs observed self-closing latch is not working properly (pictures and video were taken).
Based on LPAs observation, interviews which were conducted, and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency is being cited (see attached 9099D).
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parent. Child Development Supervisor, Samira Alvarez was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form (English/Spanish).
A notice of site visit was given and must remain posted for 30 days.
