Licensing Program Analyst (LPA) Staicy Perry conducted an unannounced complaint investigation to deliver findings for the above allegations that were reported to the department on 6/6/2024. Upon arrival LPA was greeted by Teacher Martha Maciel guided LPA on a tour of the facility. Shortly after Administrator Veronica Herrera arrived. There were 11 children present with 3 staff.

During the course of the investigation, interviews were conducted with the staff, children and parents. LPA also obtained and reviewed copies of Children's Roster, Personnel Roster, Employee Handbook, Parent Handbook, internal investigation notes and interviews and declarations obtained and a tour of the facility was conducted.

LPA called complainant to obtain further details on the allegations made. Complainant stated that teacher sent C#9 to the small office and sat C#9 on a chair and was left alone and C#9 was crying” Complainant also stated that C#9 said that teacher tore homework and then placed C#9 to the office and left C#9 in the office. Complainant did not disclose that child was pushed by teacher. Complainant also stated that administrator attempted to report to the department and was told it was not a reportable issue. Complainant did state that administrator did come out to their home and address the issues. LPA attempted multiple times to interview C#9 and was unable to interview.

LPA conducted interview with administrator. Per administer, parents of C#9 did voice their concerns to her on May 31, 2024 and she did address the issues in a timely manner. Administrator did go out to their home to investigate what had happened. Administrator did provide LPA Perry with all of the investigation notes that was conducted. Administrator stated that there was not enough evidence to say that something occurred. Administrator also stated that on June 3, 2024 in the morning a call was made to the department to attempt to report the unusual incident and was told that based on the information that was shared over the phone there was no substantial evidence and there was no need to report the incident to the department.

LPA conducted interviews with parents and children. Parents statements corroborated that the facilities communication is very well. It was stated that the facility reaches out and is very informative on communicating with them. Parents disclosed that they never see a child alone. Parents also stated that they are happy with the care and supervision that their children receive. Children's interviews corroborated that they like their school and the teachers. No disclosures were made regarding the allegations.

LPA did not observe any children being left unattended or unsupervised at any time during the course of the investigation. LPA Perry observed teachers treating children with respect and not violating a child’s personal rights. LPA did conduct a file review and facility does report unusual incidents to the department in a timely manner. LPA did inform administrator of different ways to submit unusual Incident reports, administrator understood. LPA did review reporting requirements with administrator Veronica and did obtain LIC 624 form for the incident.

This agency has investigated the complaint alleging, Child was isolated from her peers and pushed by staff member, leaving a child unsupervised, and not reporting the incident to the Department. Based upon the evidence presented above the allegations have been determined to be unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation (s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A Notice of Site Visit was provided and must be posted for 30 days.

Exit interview was conducted and report was reviewed with Administrator Veronica Herrera.
