32 | During interviews, staff disclosed that they observed Child #1 take a sip out of a paper cup that contained hand sanitizer. According to staff that hand sanitizer was placed on top of the shed that Child #1 had access to. According to Staff #3 that they observed Child #1 grab the cup and take a sip out of the cup. According to Staff #3 and Staff #4 that they observed Child #1 spit out the hand sanitizer out of their mouth and observed the child to be "gagging". Per Staff #3 that they went towards Child #1 to ensure the child's safety. Staff #3 stated that they were unaware what was inside the cup until they smell the contents of the cup and realized it was hand sanitizer. Per Staff #3 they disposed the cup in the trash can and took the child inside of the facility for further guidance by the school's leadership. Per Staff #1 that they called Poison Control for guidance to ensure that symptoms are being monitored for intoxication due to the hand sanitizer being "62%" alcohol. According to Staff #1 and Staff #4, that hand sanitizer was placed in the paper cup on top of the shed, due to the facility running out of individual hand sanitizer bottles for outdoor play time. Per staff Child #1 did not have any symptoms.
Based on interviews conducted by the LPA and the staffs’ own statements, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & chapter 1), are being cited on the attached LIC 9099D.
LPA Saul Valenzuela informed facility representative Laura Hernandez that this report dated 7/22/2025 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Saul Valenzuela informed the facility representative to provide a copy of this licensing report dated 7/22/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
