Licensing Program Analyst (LPA) Judy Mora conducted a subsequent complaint inspection to complete the investigation for the above complaint allegations. LPA met with Lead Teacher, Vicky Rodriguez. LPA conducted self tour of the facility as there was no one available to guide LPA on a tour. Staff names of all staff were recorded.

At the time of arrival, LPA observed 22 children present with one teacher and two aides. LPA also observed the housekeeper assisting with children due to there being insufficient staff present.

During the investigation LPA visually inspected the facility both indoors and outdoors, LPA conducted staff interviews and visually observed preschool staff interactions with children. LPA obtained a copy of the facility roster. LPA also obtained copies of children and staff time sheets for the week of 01/31/22-02/04/22 and 02/07/22 through 02/10/22. LPA obtained copies of staff transcripts, as staff files are not kept at the facility.

During the complaint investigation, it was found on staff and children's time sheets, that the facility has been out of ratio on more than one occasion. More specifically on 02/07/22, at 8:56 AM there were 29 kids present with one qualified teacher and two teacher assistants. Also, on 02/08/22 at 9:46 AM there were 36 children with one teacher and one aide.

Disclosures were also made during staff interviews that corroborate with the allegation of unqualified staff being used to assist with children. It was found that the housekeeper and kitchen staff have been used on more than one occasion to help with the supervision and ratio of children. LPA also observed this on 04/04/22, the housekeeper was being used to assist with children both indoors and outdoors.

Based on the available information, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter Number 1), are being cited on the attached LIC. 9099D.

These pose both immediate and potential Health and Safety risks to clients in care.

Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

Exit interview was conducted with Site Supervisor, Mirna Palomo. Appeal rights and procedures were explained and provided.

Licensing Program Analyst (LPA) Judy Mora conducted a subsequent complaint inspection to complete the investigation for the above complaint allegations. LPA met with Lead Teacher, Vicky Rodriguez. During the investigation LPA visually inspected the facility both indoors and outdoors, including inspecting the sand areas on both inspections. LPA conducted staff interviews and visually observed preschool staff interactions with children. LPA obtained a copy of the facility roster.
Although the allegation may have happened or is valid there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview conducted with Site Supervisor, Mirna Palomo. Appeal Rights explained and provided during this visit.

Teacher – Child Ratio
Persons employed for clerical, housekeeping and maintenance functions shall not be included as teachers in the teacher-child ratio.
This requirement was not met as evidenced by disclosures that were made during staff interviews that corroborate with the allegation of unqualified staff being used to assist with children.
