32 | During the complaint investigation, it was found on staff and children's time sheets, that the facility has been out of ratio on more than one occasion. More specifically on 02/07/22, at 8:56 AM there were 29 kids present with one qualified teacher and two teacher assistants. Also, on 02/08/22 at 9:46 AM there were 36 children with one teacher and one aide.
Disclosures were also made during staff interviews that corroborate with the allegation of unqualified staff being used to assist with children. It was found that the housekeeper and kitchen staff have been used on more than one occasion to help with the supervision and ratio of children. LPA also observed this on 04/04/22, the housekeeper was being used to assist with children both indoors and outdoors.
Based on the available information, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter Number 1), are being cited on the attached LIC. 9099D.
These pose both immediate and potential Health and Safety risks to clients in care.
Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.
A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.
Exit interview was conducted with Site Supervisor, Mirna Palomo. Appeal rights and procedures were explained and provided.
