An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 09/04/2025. The purpose of this inspection is to provide the findings of complaint which was received on 07/30/2025. LPA met with Principal, Barbara Walker to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, children, and parents. LPA also reviewed and obtained copies of children’s roster, personnel report, incident reports and other documentation.

Per initial complaint report, the reporting party (RP) reported that Child # 1 disclosed that a teacher has pulled on their arm roughly. During interview, it was disclosed that Child # 1 was having a hard time sleeping because their arm was hurting, because it had been pulled by a teacher. Per RP child # 1 disclosed that arm pulling had happened a lot of times, and that teacher was mean to them. -- pg. 1 of 4--

On 08/25/25 and 08/29/25 LPA Lopez received two separate unusual incidents reports regarding personal rights violations by another staff. On 08/25/25 report stated that Child # 2 disclosed that a teacher had pushed their head back and that it hurt. 08/29/25 report stated that child # 3 disclosed that same teacher mentioned on the 08/25/25 report had "turned" their hand. LPA Lopez investigated these allegations on this date 09/04/25.

In regards to complaint allegation # 1 Staff member handled child in a rough manner. LPA conducted interviews with staff # 1-6. Staff # 3-5 disclosed that the teacher in questioned would raise their voice towards children. Staff # 4 disclosed that they received concerns from parents regarding that teacher being rude and not considerate to children. Staff # 4 stated that teacher in questioned has a strong personality and has the ability to be rude and sometimes doesn’t respond appropriately with certain situations. Staff # 5 disclosed that teacher’s in questioned classroom management was more of the stricter style, punitive and humiliating. Per Staff # 5 they observed teacher grab more than 1 child from the wrist with force and yanking them. Per Staff # 6 (Principal) they have received parents concerns regarding teacher's in questioned tone of voice.

In regards to allegations on unusual incident reports- LPA interviewed staff #6-9. Per staff # 6 (Principal) Child # 2 disclosed that a teacher had pushed their head back and that it hurt- to various staff members and that child's story was consistent. Additionally, during their investigation Child # 3 disclosed to them that the teacher being investigated had hurt their hand. Staff # 7-8 corroborated the information given to them by child # 2. Per Staff # 9 they have never violated a child's personal rights.

LPA conducted interviews with children 1-8. Regarding initial complaint allegation Child # 1 disclosed that they were running and the teacher grabbed, pulled their arm and sat them down (child pointed to their left arm). Per child # 1 other children were running but the pulling of the arm sitting down only happened to them. Child # 1 disclosed that the pulling was very hard and it hurt. LPA asked child if they can demonstrate the pulling- child # 1 grabbed

LPA’s wrist with one hand and upper arm with the other hand and yanked arm with force. Child # 5 disclosed that teacher in questioned will scold and hurt children. Per child # 5 they saw that teacher making child # 1 cry. Regarding unusual incident reports LPA Lopez interviewed children- Regarding incident reported on 08/25/25 child # 2 disclosed to LPA that staff # 9 was angry and did "this" (demonstrated their head being pushed back) and that it hurt.

LPA conducted interviews with parents 1-5. Parents # 2 and # 4 disclosed having concerns regarding staff handling children in a rough manner, based on their children sharing situations or facility sharing incidents of personal rights violations that have happened.

On 9/4/2025 during inspection staff # 8 came into the office and informed Principal that Staff # 9 was in the classroom approaching and questioning teachers and child # 2 about what information was given to LPA about them. Per Staff # 8 they told staff # 9 that child was eating lunch- staff # 9 then took child with them and told child that they were lying..

This agency has investigated the complaint and unusual incident reports alleging 2 different staff members handled children in a rough manner. Based on LPAs observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. The following deficiencies listed on the attached LIC 9099D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature...

Per Principal, they willl be contacting operations to have both staff members removed from the facility. Will have a meeting with all staff members to review personal rights and mandating reporting processes. Meeting minutes and signing sheets will be submitted to LPA by 9/11/25

This requirement is not met as evidency by: Based on observations and interviews conducted the licensee did not comply with the section cited above in that 2 teachers have violated personal rights of child # 1 & # 2. This poses and immediate risk for children in care.

When discussing findings for complaint allegation received on 07/30/2025 and unusual incident reports received on 08/25/25 and 08/29/2025 with Principal Barbara Walker, she stated that she will be contacting operations regarding findings and the goal will be to have both staff members removed from the facility and not return to this center. Per Principal, they will seek for suspension- and will have a meeting with all staff members to review findings, personal rights and review mandating reporting processes. Meeting minutes and sign in sheet will be provided to LPA Lopez by 9/11/2025.

LPA Roxana Lopez informed Facility Representative Barbara Walker that this report dated 9/4/2025 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Roxana Lopez informed the facility representative to provide a copy of this licensing report dated 9/4/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.
