Licensing Program Analyst (LPA) Mireya García conducted an unannounced case management follow up inspection due to incidents that occurred on August 23, 2022 and September 14, 2022. Due to COVID- 19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA met with Office Manager, Marfa Garcia, who guided LPA on a tour of the facility. Principal, Barbara Walker was not present during this inspection. There were forty-six (46) children observed to be present at the facility during LPAs arrival.

LPA Mireya Garcia conducted interviews and obtained documentation during visits conducted on September 21, 2022 and October 12, 2022.

The incident that occurred on 08/23/22 was reported to the facility representative on 08/24/22 and the facility reported to the Department on 08/25/22, via telephone. The facility reported the Unusual Incident to the Department within the required 24 hours of occurrence.

Information reported to the Department indicated that Staff #4 violated Child #1’s personal rights.

The second incident that occurred on 09/14/22 was reported to the Department on 09/15/22, via telephone. The facility reported the Unusual Incident to the Department within the required 24 hours of occurrence.

Information reported to the Department indicated that Staff #1 violated Child #1’s personal rights.

Based upon information received from the interviews conducted by LPA Mireya Garcia on September 21, 2022 and October 12, 2022, it was determined that the personal rights of Child #1 were violated by Staff #1 and by Staff #4 on two separate occasions. During this investigation, disclosures were made by staff who confirm that Staff #1 has a history of violating children's personal rights.

This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

The following deficiency listed on the attached LIC 809 deficiencies page is being cited in accordance with California Code of Regulations Title 22.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parent. Head Teacher, Narine Barutyan was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form (English/Spanish).

A notice of site visit and a copy of this report was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with facility representative, Head Teacher, Narine Barutyan.

Per Head Teacher, on 09/20/22 Principal provided training to all staff in regards to personal rights to ensure that staff is following Title 22 Regulations.
