An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 6/29/26. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 4/9/26. LPA met with Facility Representative Nancy Mejia (Office Manager) to whom the purpose of the inspection was announced. Census was taken. Per Facility Representative, the lead teacher was out and the Principal won’t be available until 12:30 pm. Per Facility Representative there are 76 children currently enrolled. Prncipal Speight arrived at 1:00 pm

Throughout the course of the investigation, interviews were conducted with staff, and parents. LPA also reviewed and obtained copy of children’s roster and other documentation.

Per initial complaint report, the Reporting Party (RP) reported that the classroom was over ratio. Per complainant different classrooms have been out of ratio different times-----------pg. 1 of 3 -----------------

Up to 35 children with 1 teacher and 2 or 3 aides. Per complainant they have dates and times of when classes are out of ratio but this information was not provided to the LPA.

LPA conducted interviews with 9 staff members. 4 out of 9 staff corroborated that classrooms have been out of ratio on different occasions. Dates and times were not provided- per staff they had between 29 to 35 children in the classroom with only 1 teacher present.

On this date 6/29/26 LPA Lopez observed only two classrooms operating. Room # 3 had 2 9 children 1 teacher and 3 aides- second teacher was observed taking their break. Room # 5 (west bungalow) had 29 children 2 teachers and 3 aides. Throughout the inspection of today LPA observed staff taking breaks- and 1 teacher left for the day at 12:00 pm which lead classes to continue being out of ratio. This is an immediate risk for the health and safety of children care. Per Facility Representative they did not have substitutes to cover staff breaks or absences

Parents interviews were conducted with 8 parents- 3 out of 8 parents corroborated that they have observed a lot of children in different classrooms- which seemed very chaotic- but they were not sure how many children were present.

This agency has investigated the complaint alleging classroom is out of ratio. Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of the evidence standard has been met, therefore the above allegations is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 3 (FCC) (1 DCC) number) are being cited on the attached LIC9099D.

Based on observations and interviews the licensee did not comply with section cited above as staff disclosed that having up to 35 children with 1 teacher & on 6/29/26 LPA observed 29 children with 1 qualified teacher and 3 aides. This is an immediate risk for the health and safety of children in care.

LPA conducted interviews with staff and children. Per staff # 1 they talk to children at their level and redirect children. However, sometimes they do have children sit down and do another activity or talk to staff when children need that extra support. Staff # 2 and # 3 corroborated that they have not observed staff # 1 pulled any child’s arm. Per staff # 2 and # 3 they have observed staff #1 sit children down. Staff # 3 disclosed that sometimes they observed a staff sitting with the child but other times they do not.

During children’s interviews Child # 1 did not disclose their arm being pulled- but disclosed that staff # 1 “gets angry and they are scared” Child # 2 did not disclosed their arm being pulled by staff # 1. 3 out of 5 children disclosed that Staff # 1 sits them down at a table- but did not disclosed their arms being pulled.

Regarding allegation # 2 Children were left in the class without qualified teacher. LPA conducted interviews with 9 staff. 8 out of 9 corroborated that there is always a qualified teacher present in the classroom. During interviews staff had questions regarding napping ratio. LPA advised that in a preschool program 1 teacher or 1 aide can supervised 24 napping children. Other teachers/aides must be on site to meet the overall ratio when children are awake.

LPA conducted interviews with parents. Parent interviews corroborated that their children seemed happy at the facility and they did not have concerns regarding staff # 1 -3 at this time. Parents interviews corroborated that they always see staff in classrooms, but they were not able to pin point who was a fully qualified staff.

This agency has investigated the complaint alleging Staff member pulled children`s arms, made them cry and Children were left in the class without qualified teacher. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated. -------- pg. 2 of 3------------------------------------
