An unannounced subsuquent inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 7/14/26. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 5/12/26. LPA met with Facility Representative Armando Inclan to whom the purpose of the inspection was announced. Census was taken. Per Facility Representative there are 56 children currently enrolled.

Throughout the course of the investigation, interviews were conducted with staff, children and parents. LPA also reviewed and obtained copy of children’s roster and other documentation.

Per initial complaint report, the Reporting Party (RP) reported that Child # 1 and Child # 2 sustained injuries due to lack of supervision and that staff argue in front of children. During interview the RP stated that on date unknown Staff # 1 was not supervising the classroom and child # 1 was running and fell and hit their head.-------------------------------------- pg. 1 of 3---------------------------------------------------------------------------

Additionally, on another occasion, date unknown Staff # 1 was arguing with Staff # 2, resulting in Staff # 1 leaving the classroom and the table they were supervising leading to child #2 falling and hitting their head on the floor- ambulance was called. Per RP, staff # 1 and staff # 2 have had arguments in front of children – on different occasions, dates unknown.

Regarding allegation # 1: Child # 1 LPA did not observed any documentation of child sustaining injuries and no disclosures were made by Staff # 1 of child falling. Child # 1 did not disclosed falling and hurting their head. Child # 2 LPA conducted interviews with staff # 1-4 who corroborated that child # 2 was observed running and then went back to an unsupervised table. Child # 2 then began crying and staff noticed child # 2 on the floor and they assumed child fell off the chair- since child was laying next to the chair. Fall was not directly observed, and staff was unsure of who was supposed to be supervising that table. Staff corroborated that ambulance was called to check on child #2 but was not transported. Child # 2 is non verbal.

Regarding allegation staff argues in front of children- Per staff # 1 they do not have issues with other staff, but staff have issues with them. Staff # 1 did not disclosed arguing in front of children. Staff # 2 disclosed that they have had arguments with staff # 1 in the passed and they have been in front of children. Staff # 3 and #4 corroborated that they have observed arguments involving staff # 1 on passed occasions dates were not given.

During parent interviews- parents corroborated that ever since there has been a change on administration- the communication and relationships between staff seem off.

This agency has investigated the complaint alleging Child Sustained injury due to lack of supervision and Staff argues in front of children. Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of the evidence standard has been met, therefore the above allegations is found to be SUBSTANTIATED.

Allegation # 1 child sustained injury due to lack of supervision was cited on a case management incident inspection report dated 7/14/2026.

Allegation # 2 staff argues in front of children- based on interviews it was determined that these arguments occurred a while back. LPA cited facility regarding this allegation in a case management incident inspection report in 12/24/25. No new disagreements were mentioned by staff # 1 out staff # 2.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Principal Rafael Inclan

During interview with RP they stated that they did not have dates regarding allegations # 1 and 2. Regarding allegation # 3 RP disclosed that they did not feel comfortable with the “length” that staff # 6 was patting child # 4. LPA verified what they meant by length- per RP staff # 6 was patting from bottom of neck to lower back “but they didn’t touch the bottom,” The RP disclosed that staff # 6 had child # 4 on their lap instead of a chair.

Regarding allegation #1: staff yelled and held child by hand- LPA conducted interviews with staff and children. Per staff # 5 they talk to children at their level and redirect children. Staff # 5 did not disclosed yelling at child or holding their hand. Staff # 6-8 corroborated that they have not observed staff # 5 yelled and hold a hand of a child.

During children’s interviews Child # 1 is no longer enrolled in facility and parent did not confirm an interview with child. Children interviews did not disclosed staff # 5 yelling.

Regarding allegation # 2 Teacher assistants are left in the classroom to supervise children. LPA conducted interviews with 9 staff. 8 out of 9 corroborated that there is always a qualified teacher present in the classroom. During interviews staff had questions regarding napping ratio. LPA advised that in a preschool program 1 teacher or 1 aide can supervised 24 napping children. Other teachers/aides must be on site to meet the overall ratio when children are awake.

Regarding allegation # 3 Staff # 6 did not follow facility nap policy. Per Staff # 6 they were helping child sleep by patting their back- when child was not falling asleep they sat child on their lap and was going to read a book to them. Per Staff # 7 they did not observed staff # 6 doing anything wrong. They observed staff # 6 pat child and then sat them on lap to read a book. Per staff # 7 they asked staff # 6 to offer child to sit next to them to read the book which they did.

Children interviews did not disclosed feeling uncomfortable with patting.

LPA conducted interviews with parents. Parent interviews corroborated that their children seemed happy at the facility and they did not have concerns regarding staff at this time. Parents interviews corroborated that they always see staff in classrooms, but they were not able to pin point who was a fully qualified staff.

This agency has investigated the complaint alleging (1) Staff # 5 yelled and held child # 3 by hand (2) Teacher assistants are left alone with children in the classroom and (3) Staff # 6 did not follow facility nap policy. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

No deficiencies cited for these allegations. A notice of site visit was given and must remain posted for 30 days. Exit interview was conducted and report was reviewed with the facility representative Principal Armando Inclan.
