32 | Per RP child # 1 was not receiving the support they needed and staff # 1 and Staff # 2 were instigating child. Per RP they heard staff # 1, yell at child in Spanish # 1 “ to be quiet and that they will not be able to stay in the school or go outside.” Then staff # 1 proceeded to ask staff to continue with circle time. Per RP they were in the carpet over 40 minutes. Additionally, RP stated that staff # 1 yanked child # 2. LPA interviewed co- complainant who reported that they were notified that child # 1 was having a hard time in the classroom. Per Co- complainant when they arrived to the facility they observed child # 1 separated from the other children and staff # 1 was rude and asked for child # 1 to be taken home. Per Co- complainant staff # 1 did not allowed child # 1 to clean up after themselves or explained what had happened. Additionally, co- complainant disclosed that they are aware that staff # 1 has been rude to staff – therefore they do not doubt that staff # 1 is also rude to children.
LPA conducted interviews with staff. Per staff # 1 they are called into the classroom when staff need extra support. Staff # 1 disclosed that they have been called into different classrooms to support with behavior issues- in one occasion they were called because a child was disturbing instructional time as they were hurting other children and throwing furniture in the classroom. Per staff # 1 they called authorized representatives to informed them of what was happening but did not ask for child to be picked up. Staff # 1 when into the classroom to provide support and asked the other staff to continue with instructional time. Per staff # 1, authorized representative arrived to the classroom upset and began yelling and stated they will be taking child # 1 home. Staff # 1 corroborated that they did not allowed them to clean up as teacher were still trying to conduct instructional time. Per Staff # 1 they never spoke inappropriately to any children or yanked any child.
Interviews with staff # 2 and # 3 corroborated that when children are having a hard time they talk to children at their level and redirect them as needed, however sometimes extra support is needed. Per staff # 2 and # 3 child # 1 was having a hard time in the classroom as they were trying to hurt friends and throwing furniture. Per staff # 2 they asked the other staff if in the classroom to move the other children back and asked staff # 1 for support. Per staff # 2 and # 3 when staff # 1 arrived, they continued with instructional time. Staff # 2 and # 3 corroborated that they did not hear staff # 1 speak inappropriately to child # 1 or any children and did not observed staff # 1 yank child # 2 or any children. Additionally, staff # 2 and # 3 corroborated that Staff # 1 was calm during the whole process, even when authorized representative arrived and was upset and yelling. ----------------------------------------------- pg. 2 of 3 ----------------------------------------------- |
