Licensing Program Analyst (LPA) Mireya García conducted an unannounced Case Management inspection follow up due to an incident that was reported to the Department on October 20, 2022. Due to COVID- 19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA met with Principal, Josefina Navarro who guided LPA on a tour of the facility. Census was taken.

On October 20, 2022, an incident was self reported to the Department via telephone by the facility who reported a parent alleges that child's personal rights were violated while in care. The purpose of the inspection was to obtain additional information regarding the allegation reported to the Department.

During this investigation, LPA conducted interviews with Principal, four (4) staff, four (4) day care children and parent of child in question. All interviews conducted with Staff deny observing Staff #4 or any staff grab child #2 inappropriately. Staff #4 disclosed grabbing child #2 by the arm to prevent child from running out of the school gate during departure. No disclosures were made by all four (4) children interviewed including child in question. Parent of child #2 disclosed after speaking with witness and Staff #4 the parent realized child #2 was grabbed by the arm for child’s own safety. Based on the interviews conducted, at this time there is not enough evidence to support that a child #2’s personal rights were violated while in care by Staff #4.

A notice of site visit was given and must remain posted for 30 days.
