On October 15, 2024, Licensing Program Analyst (LPA) Staicy Perry conducted an unannounced complaint investigation for the above allegation. A COVID-19 risk assessment was conducted prior to entering the facility. LPA met with Licensee, Leticia Gutierrez who guided LPA on a tour of the facility. Also present in the home was assistant Jasmine Garcia, licensees husband Pedro Gutierrez and Veronica Velazquez, housekeeping. All adults present in the home are fingerprint cleared. LPA observed 4 children in care.

Throughout the course of the investigation, interviews were conducted with staff and parents. LPA also reviewed and obtained copies of children’s rosters, sign in and out sheets and other documents.
RP alleged “out of ratio”; Per RP, there was 13 children at one time on 8/2/2024 and 9/3/2024. R.P. stated that facility license states facility is only licensed for 12 children. LPA interviewed S#1-S#2, S#1 did disclose that facility has been operating over ratio on several occasions due to being unaware of Title

22 regulations pertaining to a large Family Childcare home when an assistant is not present as well as having more children than her licensed capacity of 12. S#1 also disclosed that facility has been over ratio due to S#2 only working 9:00am- 2:00pm Monday-Friday and due to children’s schedules, that vary on a daily basis. S#2 stated that she only works from 9:00am-2:00pm Monday through Friday and does not stay past their scheduled time.

LPA interviewed P#1 -P#7 who all corroborated that they have never seen licensee Leticia alone with more than 8 children and there is always an assistant present at the facility. LPA observed the facility roster and observed 13 children enrolled on the roster. LPA reviewed and observed sign in and out sheets for the month of August 2024, September 2024 and October 2024. LPA did observe that on August 2, 2024, September 3, 2024 and October 1st, 2nd and 3rd 2024, licensee was observed to be out of ratio and operating out of the capacity limitations of her license.

Based on interviews conducted by LPA Perry, documentation obtained, and records reviewed allegations of facility operating out of ratio, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & chapter 1), are being cited on the attached LIC 9099D.



LPA Staicy Perry informed Licensee Leticia that this report dated 10/15/2024 document(s) 2 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Staicy Perry informed the licensee Leticia to provide a copy of this licensing report dated 10/15/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit.

A notice of site visit was given to licensee Leticia and must remain posted for 30 days.

Exit interview was conducted with licensee Leticia and appeal rights discussed and provided.

Licnesee stated that she will ensure she is following her licenseced capacity number of children. Licensee will submit a declaration stating she will adhere to to all ratio and licensed capacity by POC date to LPA via email.
