On 08/22/2023 at 11:08AM, Licensing Program Analyst (LPA) Thelma Razo conducted an unannounced Case Management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. A COVID 19 risk assessment was conducted prior to entering the facility. LPA met with facility Director Veronica Herrera during the visit. Also present in the facility were 14 toddlers, 6 children, 4 teachers and 2 aides. Facility was within ratio & capacity.

Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility Director during the inspection. Per AB 2370, all CCCs that are in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.
Facility provided facility sketch and required forms LIC 9275, LIC9276 and LIC999 to LPA during this inspection. On 1/06/2023, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW).
The SWRCB report indicated the facility was inspected and samples were collected on 12/24/2022. Faucets and drinking fountain reported with 5.5 ppb or greater lead exceedance levels were as follows:

  • Drinking Water Filter Dispenser - F (8.15 UG/L) – LPA obtained a copy of retesting result dated 8/1/23 which indicate that it passed the lead test. Sample were obtained on 7/29/23.
  • During this inspection, LPA observed that the sink faucet in the staff lounge located on the second floor has a retesting result of 8.3 UG/L. The sink faucet was covered with plastic bag with sign as follows: Out of Service - Do not use until removed by sampler.
Director stated that the facility has not been using the drinking water filter dispenser and the sink faucet as soon as the result of lead test was received. Children used the kitchen water dispenser which passed the lead test. Facility utilized water jugs for indoor and outdoor use. Children have no access to the second floor where the staff's sink faucet is located.
Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. For Lead Testing and Prevention Information, including additional resources please visit

A deficiency was cited during this inspection. See LIC809D.
A notice of site visit was also provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

During today's inspection, LPA observed the sink faucet was covered with plastic bag and has a sign indicating out of service. Retesting result has indicated drinking filtered dispenser passed the lead test. Per Director, LPA will be provided with a copy of the restesting result for the staff lounge sink faucet.
