32 | Allegation regarding- day care over ratio. According to the RP, S1 was alone with 9 children, 4 out of the 9 children were infants. RP also stated that the licensee was not home and asked S1 to seek additional assistance. S1 was able to call S2 to be in compliance with Title 22 regulations. Per S1, S2 approximately arrived at 12:00pm and remained at the facility until the end of the day. LPA interviewed S1, who made disclosures. According to S1, they had 12 children present at the facility. Out of the 12 children present 6 were infants. S1, stated there is a staggered schedule and based on the schedule, S1 had arranged to have a 1-day trial for 2 new potential children. Parents of the 2 children that were not scheduled to be at the facility, unexpectedly arrived. Licensee decided to accept both children that were not scheduled on that day. Per S1, a discussion occurred with the licensee regarding the 2 children that arrived unexpectedly. Per S1, both families should’ve been turned away; however, the licensee decided to help both families as they needed child care services. Both children are enrolled at the facility. Licensee had to leave unexpectedly.
Based on interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).
A notice of site visit was given and must remain posted for 30 days.
Exit interview conducted and report was reviewed with licensee's assistant Gratzia Quijano.

Also, LPA Veronica MartinezGarza informed the licensee’s assistant Gratzia Quijano to provide a copy of this licensing report dated 06/24/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
