Complainant alleges HCO using 1099 workers as Home Care Aides

On 3/3/26, Home Care Services Branch Enforcement Analyst (EA), Ryan Chan conducted a complaint investigation visit regarding the above complaint allegation. Upon arrival, EA met with licensee Scott Yoon.

Reporting party (RP) alleges that during an interview, home care aide (HCA) disclosed to RP that she did not have a social security number, RP believes she was paid 1099 or under the table.

During the course of the investigation EA interviewed the licensee and licensee’s wife. EA reviewed the application document turned in by the HCA which stated HCA worked for Mae Morgan Staffing from November 2022 to present. EA attempted to interview the HCA who disclosed the information to RP, however, EA did not receive a call back from the HCA despite several attempts.

Next door to this HCO is a business called Mae Morgan Staffing which is owned by licensee’s wife which is under a different corporation as this HCO. Mae Morgan Staffing is a referral agency whose primary business is referring clients with caregivers who are independent contractors. HCO licensee stated he has not had any clients since the HCO's inception and no home care aides employed, no payroll records could be provided for review.

Based on the evidence gathered and interviews conducted, the preponderance of evidence standard has not been met, therefore the above allegation is found to be UNSUBSTANTIATED.

EA concluded the visit with an exit interview and provided a copy of this report along with appeal rights to the licensee.
