32 | In total LPA observed 8 infants and 27 toddlers. Facility is operating over capacity. License specifies that the total capacity of the license serves 30 children which include 12 infants and 18 toddlers.
LPA informed Director, ROSHAWN T HOOPER that the facility was over capacity and obtained copies of children's roster for both the preschool and Infant license. Upon going back to the Toddler B classroom, LPA observed the 11 toddlers being relocated to the Preschool 3's classroom. LPA asked Director why children who were first observed in the toddler classroom B were being relocated to the Preschool 3's classroom, Director stated that the "daily schedule consists of utilizing both rooms if needed".
LPA obtained the names from Adult 1 (A1), of the 11 children that were moved into the Preschool 3's classroom as well as copies of the children's rosters. Upon review, LPA observed that some children were listed under the Infant/toddler roster (195700097) and others were listed under the preschool roster(195700098) and children are co-mingling.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, 1 type A deficiency and 3 Type B deficiencies are being cited. (See LIC809-D)
Licensee was advised upon receive of this report, the report must be posted along with the notice of site visit for 30 days for parents to view. Licensee must inform the parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months via form LIC 9224 Acknowledgement of Receipt of Licensing Reports. If the Licensee fails to comply $100.00 civil penalty shall be assessed for each family enrolled and in attendance. Exit interview conducted with the licensee and a copy of this report was provided along with the appeal rights.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Director, ROSHAWN T HOOPER including, but not limited to Provider Rights, Appeal Procedures.
