On 4/20/2026, Licensing Program Manager (LPM Rita Ramos and Licensing Program Analyst (LPA) Amelia Morales conducted an Unannounced Required- Annual inspection at the above facility. LPM and LPA arrived at approximately 9:20AM. LPA and LPM was greeted and let into the facility by Licensee. Facility refers to themselves as "Magies Child Care Daycare." The Entrance Checklist was provided to help facilitate the inspection. Facility is currently licensed for a capacity of 14 children. LPA and LPM observed 3 children with Licensee.  Children's roster was reviewed and is not current. Facility operating hours are Monday through Friday 8:00AM to 5:30PM, however, per Licensee they can care for children up until 11PM if needed.

This is a single dwelling home which consist of; front yard (fenced),  bedroom #1 (daycare room), bedroom #2, laundry room, bathroom #1, living room, garage, and backyard (fenced). Per Licensee, parents and children use the side gate leading to the back yard.  It should be noted that during the walk through LPM and LPA observed cameras located outside the facility as well as inside the living room, and bedroom #1 (daycare room). Licensee informed LPM and LPA that the cameras do not currently work. should be noted there are cameras inside and outside the facility.
Per Licensee, areas off limits to children and parents include: laundry room, the kitchen which has a baby gate making the kitchen inaccessible. The stove, refrigerator, sink and counter space area were observed and inspected. Knives and sharp objects observed to

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Based on observation, the licensee did not comply with the section cited above in LPA and LPM observed 6 cement stone sculptures that are on the outdoor play area. LPM was able to move one with their pinky and index finger that was on the edge of a garden bed that can fall on a child. There is a metal rod that sticks out of the ground that a child can fall on. There is a small electrical box that has metal protruding on the sides that have pointy sharp corners. There is another area with metal pipes protruding from the ground and 2 unraveled water hoses that are a tripping hazard, which poses an immediate health, safety or personal rights risk to persons in care.

be made inaccessible to the children in care. Licensee has a garage located next to the kitchen, Licensee opened the door and stated it was off limits. LPM and LPA observed cots and playpens, Licensee stated that the garage is used as storage. LPM and LPA requested an updated facility sketch be submitted to the Regional Office (R0). Since LPM and LPA observed that garage looks to be a bedroom, LPM and LPA requested a building permit showing the conversion. Per Licensee they do not have a permit for the garage and the home was purchased with the garage conversion. Due to Licensee stating that the garage is used for storage, LPM informed Licensee that the garage is to be maintained closed and inaccessible at all times.

During the walk through Licensee informed LPM and LPA that their bedroom #2 is off limits. LPM and LPA observed bedroom being easily accessible, LPM and LPA advised to place a lock in the bedroom to make it inaccessible for the children in care due to LPM and LPA observing that the door does not latch or close.

Per Licensee, areas on limits to the children in care are; living room, bedroom #1 (daycare room), bathroom #1, and backyard (fenced). Sleeping area was observed in the living room, ample amounts of cots were observed as well as play pens. Licensee informed LPM and LPA sheets are provided by Licensee and are laundered weekly. LPA observed a completed first aid kit located in the living room.

Per Licensee, food is provided such as breakfast, lunch, snacks and dinner. The children eat in the living room. Children utilize the front yard (outside playing area). Per Licensee, when children are having outside time, they will ensure 100% supervision and never leave children unattended. There were no bodies of water on the present. Per Licensee there are no firearms on the premise.

LPA and LPM observed the following: the home indoors is clean and orderly. There were age-appropriate toys and play items. Licensee was informed that baby-walkers, bouncers, jumpers, and other prohibited items will not be used for children in care. All electrical outlets have safety covers. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked with a key or combination lock. LPA did not observe a pet at the time of visit. Per Licensee, isolation area for sick children is in bedroom #1 (daycare room).

LPA observed the required (2A10BC) fire extinguisher mounted in the kitchen. Although Licensee had a fire extinguisher it did not have a Fire Marshall tag, nor a receipt indicating that it was purchased. LPM and LPA reminded Licensee that a required (2A10BC) fire extinguisher must be purchased or charged yearly. There is a smoke detector located in the living room and in bedroom #1 tested and found to be operable. LPM and LPA did not observe a carbon monoxide detector.

The last emergency disaster drill was not on file. LPA Morales reminded Licensee that emergency disaster drills must be done every 6 months. The Licensee has an expired, Pediatric 1st Aid and CPR card. The Licensee showed us an expired certification. Proof of immunization against influenza, and measles was readily available during today’s inspection. However, there was no pertussis, on file. The Licensees has an expired AB 1207 Mandated Reporter certification with no record of an updated training provided.
LPM and LPA reminded Licensee that the AB1207 Mandated Reporter Certification and Pediatric 1st AId and CPR must be renewed every two years. LPA also reminded Licensee that Pediatric First Aid and CPR must be taken in person.

One of the three files reviewed did not have Notifications of Parent Rights. One file of the three files reviewed did not have the Liability Insurance on file. One of the three files did not have the Consent for Emergency Medical Treatment.

At approximately 12:09 PM LPM and LPA observed Child #1 and Child #2 placed in a play yard for nap time. LPM and LPA inquired the ages of the children, per Licensee Child #1 is 3 years old and Child #2 will be 3 years old in 2 weeks. LPM and LPA informed Licensee that placing preschool children in the play yard is restraining them. Licensee stated they would remove the children and place them in the cots. LPM and LPA informed Licensee that play yards are meant for infants/toddlers under the age of 2 years.

Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
 
LPA discussed the safe sleep regulations with licensee, and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep, as an additional resource. LPA also informed [applicant, licensee, or facility representative] of the importance of checking for and removing recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA and LPM  informed Licensee to never accept a sleeping child in the car seat. Licensee stated that she does not accept infants in car seats. Page 4 of 5

LPM and LPA informed licensee Margarit Zakevosyan that this report dated (04/20/2026) documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
LPM and LPA informed the licensee to provide a copy of this licensing report dated (04/20/2026) that document any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
