Based on interviews conducted with the licensee, the assistant, two English-speaking enrolled children, and five parents, there is insufficient evidence to support the allegation that adults in the home are smoking in the presence of day care children.
All interviewed parents and children stated they have never observed any adults in the home during child care hours other than the licensee, the assistant, and the licensee's children who are under 18 years of age. Parents further stated they have never observed any adult resident smoking during pick-up or drop-off times.
During interviews, the licensee and assistant stated that their spouses, who reside in the home, are not present during child care operating hours because they work from approximately 7:00 AM to 8:00 PM. The licensee disclosed that her spouse only smokes outside the front of the home during non-child care hours only. The assistant stated that her spouse, who also resides in the home, does not smoke due to medical issues.
Additionally, throughout LPA Gil's inspections and observations of the facility, LPA Gil has never observed any other adult residents present in the home during child care operating hours. LPA Gil has also never observed any smoking occurring at the family child care home during inspections.
Based on LPA Gil's review of interviews conducted during the investigation, the allegation may have occurred or may be valid. However, there is not a preponderance of evidence to prove that the alleged violation did or did not occur. Therefore, the allegation is determined to be unsubstantiated.
An exit interview was conducted, and a copy of this report was reviewed and provided to the site supervisor, Marianna Mamulan.
A notice of site visit was given and must remain posted for 30 days.
