32 | During today's inspection, interviews were conducted with four staff, an observation of Room C was conducted, and documentation in the form of the 2110-Master List of Participants Roster List for classrooms C-F, a copy of an email dated 02/03/26, a copy of the Daily Health & Safety Inspection for the month of February for Child 1; and a printout from the Learning Genie app message.
Pertaining to the allegation that, "Staff did not provide adequate supervision resulting in a child being injured":
According to the Reporting Party, a scratch was observed on the chest of Child #1 the night of 02/02/26. Though the scratch looked like it had been treated, when confronted the following day, staff acted as if they were not aware of the scratch and denied that anything had occurred at the Center.
According to staff interviewed, Child #1 is active, loves to play, and is adjusting to balancing. Child has been enrolled since August 2025. Beginning November 2025, that child has arrived at school with scratches on various parts of their body has been documented on the "Daily Health & Safety Inspection." Staff stated that the scratch in question was not observed because the child's shirt was not lifted up or removed on 02/02. During today's visit, LPA & LPM conducted an observation of the classroom and the interaction between Staff #2 and Child #1. Staff #2 was alert, attentive, and spoke to children in a calm tone, bending down to meet the children on their level. Child #1 was unable to be interviewed. The printout from the Learning Genie app contained a photo of Child #1 and the scratch sustained.
As it is unknown how child sustained the scratch, the allegation that "Staff did not provide adequate supervision resulting in a child being injured" has been determined to be Unsubstantiated. That an allegation has been determined to be Unsubstantiated means that the allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.
