32 | Allegation #1: The investigation did not reveal evidence that Staff #1 provided care and supervision while under the influence of alcohol or drugs. The licensee and Staff #1 denied that the alleged incident occurred. Interviews conducted during the investigation did not corroborate the allegation.
Allegation #2: Interviews with children did not reveal any information indicating that Staff #1 communicated inappropriately in their presence. The children interviewed did not report observing any inappropriate communication by Staff #1.
Allegation #3: Interviews with children revealed that they felt safe while being transported by Staff #1. Child #1 disclosed that on one occasion another vehicle came close to colliding with the vehicle Staff #1 was driving; however, no collision occurred. Child #1 stated that the incident was a close call and was not caused by Staff #1.
Allegation #4: Interviews with children revealed that they were supervised by staff during daycare hours. The children interviewed did not report observing a child outside of the facility without supervision during daycare hours.
Based on the information obtained during the investigation, including witness interviews and available evidence, there are inconsistent statements and insufficient evidence to determine that the allegations occurred by a preponderance of the evidence. Therefore, the allegations are rendered Unsubstantiated at this time.
A finding that a complaint is Unsubstantiated means that, although the alleged conduct may have occurred or the allegation may have some validity, the evidence obtained during the investigation does not establish, by a preponderance of the evidence, that the alleged violation occurred.
An exit interview was conducted. A copy of this report was reviewed with and provided to the facility on this date, along with a copy of the appeal rights and Notice of Site Visit. |
