On 03/13/2024 at 8:00 am, Licensing Program Analyst (LPA) Silva Garibyan arrived at Onegeneration to deliver the findings of a complaint received by the Department on 12/29/23 associated to Complaint Control Number 58-CC-20231229121223. LPA met with Director, Adena Amalian, and explained the purpose of the visit. During today’s visit, there were 20 staff providing care to 93 children.

During the investigation into the allegation listed above, LPA obtained a copy of the camera footage provided in the form of a link and conducted interviews with five staff.

The allegation indicates that “Staff handled day care child in a rough manner.”

Per the Reporting Party (RP), Staff (S5) pulled Child(C1) off a tricycle, dragged them across the playground, and slammed them down on the ground. RP stated C1 has been having behavioral issues since this incident.

When interviewed, Director shared video footage on the reported date of 12/19/2023 which shows that C1 was handled in a rough manner. During school's investigation S1 watched the video surveillance and witnessed the incident described by C1’s parents. Shortly after S1 confirmed the allegation made through video surveillance, and identified the individual, the school proceeded with their company policy and removed the teacher involved out of the classroom and placed the teacher on leave of absence until the investigation was completed. On December 21,2023, the incident was reported to Community Care Licensing. On December 27, 2023, the school concluded the investigation and made the decision to terminate the individual in the incident (S5).

Based upon the evidence as presented above, the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12 Chapter 1, Article 06. Continuing Requirements, Section 101223 Personal Right is being cited on the attached LIC9099D.

Please refer to LIC9099D for documentation of deficiencies.

A copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months. The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

A copy of this Report (LI9099s/9099D), Appeal Rights (LIC9058), and Notice of Site Visit were reviewed and provided to the Director, Adena Amalian.

The allegation indicates that “Staff yelled at day care child.


Per the Reporting Party (RP), in May of 2023 Staff (S6) yelled at Child (C1) in front of her. RP stated she was arriving to pick them up and they opened a gate so they could run to her and S6 yelled "don’t open the gate, you can’t do that!" RP stated C1 started crying and she told the Director they needed to be moved into another classroom.

When interviewed, S6 stated that her class was playing outside when C1's mother arrived to pick them up. C1 ran up to the gate that separates the preschool yard from the infant yard. S6 was supervising some distance away and saw C1 touch the latch on the gate and start to open it. Because S6 was not in proximity, S6 used a loud tone of voice to say "do not touch the gate." C1 stood at the gate and began to cry. Their mother approached them and got down to their level to comfort them. After a moment S6 joined them. S6 acknowledged using a loud tone of voice to get C1's attention, explaining that she was not only far away, but concerned for their safety and that of the other children present.

Based upon interviews conducted, as documented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No deficiencies are being cited for the allegation listed above.

Notice of site visit was given and must remain posted for 30 days.
