32 | When interviewed, Director shared video footage on the reported date of 12/19/2023 which shows that C1 was handled in a rough manner. During school's investigation S1 watched the video surveillance and witnessed the incident described by C1’s parents. Shortly after S1 confirmed the allegation made through video surveillance, and identified the individual, the school proceeded with their company policy and removed the teacher involved out of the classroom and placed the teacher on leave of absence until the investigation was completed. On December 21,2023, the incident was reported to Community Care Licensing. On December 27, 2023, the school concluded the investigation and made the decision to terminate the individual in the incident (S5).
Based upon the evidence as presented above, the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12 Chapter 1, Article 06. Continuing Requirements, Section 101223 Personal Right is being cited on the attached LIC9099D.

A copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months. The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
