On 6/27/2024, Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced follow up complaint inspection for the purpose of delivering the findings for the above-mentioned allegation. Upon arrival, LPA were greeted and let into the facility by Heidi Hamilton - Assistant Director, to whom the reason for the inspection was announced. LPA toured the facility and observed 0 daycare children and 17 staff. Facility is temporarily closed 6/24/2024-6/28/2024.

During the course of the investigation, LPA Ornelas made observations, obtained documentation in the form of children’s roster, staff roster, video recordings, and interviewed staff in regard to the above allegation.

-Pertaining to the allegations that -Staff handled day care children in a rough manner.

According to the reporting party (RP), staff pushed down infant child 2 (C2) by their back onto the cot, causing child to almost hit their forehead on the top of the plastic cot. RP states per the client, staff

-Pertaining to the allegation that - Staff hit day care children.
According to the RP, staff hits children on the mouth and described the hit as a little more than a light pat.
According to Staff 1 (S1) Staff 2 (S2), Staff 4 (S4), Staff 6 (S6), Staff 8(S8) and Staff 9 (S9). They have never observed staff yell at children in care.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.

A notice of site visit was given and must remain posted for 30 days.

grabbed, shook child 1 (C1). RP states per the client. RP states per the client, other staff have also noticed how staff handles the children roughly.

According to Staff 3 (S3), Staff 8 (S8), Staff 9 (S9), they have observed Staff 2 (2), not having patience with the young children, getting frustrated and having an inappropriate tone with the children. Staff also stated that during nap time S2 pats children on the back a bit hard.

LPA Ornelas reviewed video footage and observed S2 gently patting infant C1 on the back during naptime; however, C1 then lifted their head up and S2 reacted by pushing C1’s head back down towards the cot. The action was repeated when C1 lifted their head again and S2 responded a second time by pushing C1’s head back down again. LPA then observed S2 abruptly pull what looked like a small blanket from behind C1’s head and getting close to C1’s face while saying something and placing the blanket in front of C1. LPA was unable to determine what was being said in the video due to there being no audio.

Based on the information obtained through observations and interviews, the allegation is substantiated. A substantiated finding means that the complaint is substantiated and the allegation is valid because the preponderance of the evidence standard has been met.

1 Type A deficiency is being cited on the attached LIC9099-D.

A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next twelve (12) months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent.

A notice of site visit was given and must remain posted for 30 days.
