On July 9, 2026, at 2:15 P.M., Licensing Program Analyst (LPA) Joselito L. Del Mundo conducted a follow up complaint inspection to KinderCare Learning Center. The purpose of the inspection was to deliver the findings regarding the above complaint allegations. Upon arrival, LPA met with Director Genesis Benitez and was granted access to the facility. LPA observed a total of eight sleeping toddlers inside the room with one staff providing care and supervision. LPA obtained copies of the Sign in and out sheet.

The investigation included interviews with parents, staff members, and the director, as well as a review of relevant documents.

On April 17, 2026, the Department received an allegation alleging that staff do not follow reporting requirements. Based on confidential interviews, the center determined that there were incidents that occurred on April 10, 2026, involving an infant with diarrhea and another infant being exposed. The

director admitted that it was uncertain if this incident needed to be reported to the Department.

Type B deficiency was cited in accordance with the California Code of Regulations Title 22, Division 12, Chapter 1, regulations 101212 Reporting Requirements, on the attached LIC 9099D.

Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and a copy of this report and appeal rights were reviewed with facility director Genesis Benitez.

101212 Reporting Requirements
(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.

Staff will undergo retraining on the submission of incident reports and will provide a copy of the attendance sheet for staff training.

Based on record review, the facility did not comply with the section cited above by failing to provide a timely incident report for a child being exposed to diarrhea which posed a potential Health, Safety or Personal Rights risk to persons in care.
