On 6/12/2024, Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced follow up complaint inspection for the purpose of delivering the findings for the above-mentioned allegations. Upon arrival, LPA was greeted and let into the facility by Licensee, HOMA BAYBORDI to whom the reason for the inspection was announced. LPA toured the facility and observed 12 daycare children and 2 staff.

During the course of the investigation, LPA Ornelas made observations, obtained documentation in the form of children’s roster, and conducted interviews with Staff, Parents and children in regard to the above allegations.

-Pertaining to the allegation that - Licensee yelled at day care children.
According to the Reporting Party (RP), licensee yells at children.

According to Child 1 (C1), and Child 2 (C2) licensee is nice and does not yell at them.

According to Parent 1 (P1), Parent 2 (P2), Parent 3 (P3), Parent 4 (P4) and Parent 6 (P6) they have no concerns regarding the manner in which teachers speak to the children while at the Family Child Care (FCC). Parents stated that their children like the FCC and have no concerns regarding their children being yelled at. Parents stated that the providers treat their children with respect and their children love attending the day care.

According to Staff (1) Staff (2) and Staff (3), children are not yelled at and are spoken to respectfully at all times.

-Pertaining to the allegation that - Licensee inappropriately disciplined day care children.
According to the Reporting Party (RP), inappropriately disciplines children in care.

According to Child 1 (C1), and Child 2 (C2) licensee does not hit, grab or shake them

According to Parent 1 (P1), Parent 2 (P2), Parent 3 (P3), Parent 4 (P4) and Parent 6 (P6) they have no concerns regarding the manner in which teachers discipline children while at the Family Child Care (FCC). Parents stated that their children like the FCC and have no concerns regarding their children being disciplined inappropriately. Parents stated that their children love attending the day care and are happy when being dropped off and run to their teachers. Parents further stated that their children have never expressed being disciplined inappropriately.

According to Staff (1) Staff (2) and Staff (3), children are not disciplined inappropriately. Discipline policy includes separating children if there is a disagreement between them. Having them sit for a while to return to baseline, communicating with them and offering a different activity.

-Pertaining to the allegation that - Licensee did not prevent day care children from eating pet food.
According to the Reporting Party (RP), Licensee did not prevent day care children from eating pet food.

According to Child 1 (C1), and Child 2 (C2) licensee does not give them dog food to eat. Children further stated that they do not see or know where the dog food is.

According to Parent 1 (P1), Parent 2 (P2), Parent 3 (P3), Parent 4 (P4) and Parent 6 (P6) they have no concerns regarding their children accidentally ingesting dog food while at the Family Child Care (FCC). Parents stated that they have never observed dog food inside or outside of the day care. Parents further stated that they have never observed the dogs in the same space as the children but have observed the dogs in an inaccessible gated back yard area away from the children.

According to Staff (1) Staff (2) and Staff (3), children have never ingested dog food.

-Pertaining to the allegation that - Licensee did not maintain the home in a clean and sanitary condition.
According to the Reporting Party (RP), Licensee did not maintain the home in a clean and sanitary condition. Home is dirty and not in clean condition.

According to Parent 1 (P1), Parent 2 (P2), Parent 3 (P3), Parent 4 (P4) and Parent 6 (P6) the day care is always clean and there are rooms dedicated to child care that are always clean in addition to the rest of the home also being clean. Parents stated that the home is cleaner than other day care facilities and never smells. Parents further stated that every morning upon drop off, the inside of the home is clean and tidy and the outside area is in great condition having been renovated.

According to Staff (1) Staff (2) and Staff (3), home is cleaned daily and as needed.

-Pertaining to the allegation that - Licensee did not meet day care children's diapering needs.
According to the Reporting Party (RP), Licensee did not meet day care children's diapering needs by putting diapers on children while in care and removing them when parents pick them up.

According to Parent 1 (P1), Parent 2 (P2), Parent 3 (P3), Parent 4 (P4) and Parent 6 (P6) they have no concerns regarding their children’s diapering needs and their children have never had any rashes while in care. Parents stated that they have observed how diligent staff is at making sure children’s diapers are changed immediately which is a priority.

LPA Ornelas made observations and observed staff speaking with children appropriately and discipline was appropriate for children's age while respecting their personal rights. LPA did not observe dog food in the areas where children are present/on limit areas. LPA observed the home to be clean, tidy and in good condition for children bot h inside and outside. LPA observed staff changing children's diapers as needed and discarding of waste appropriately.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.
A notice of site visit was given and must remain posted for 30 days.
