32 | The Reporting Party (RP) stated that C1 claimed the Licensee yanked them to put them inside the house. However, RP did not see any injuries on C1’s body. When C1 was interviewed, no disclosures of being handled roughly were made.
Parent #1 (P1) reported that C1 was crying when they arrived to pick up the child and stated that the Licensee had grabbed them. P1 also mentioned a broken tree branch on the floor inside the house. The Licensee explained that C1 had been pulling on a tree branch and, because the branch was high up, P1 assumed the Licensee grabbed C1, which led to their request to see the video footage.
Staff #2 stated they did not see the Licensee handle the child roughly but did hear C1 crying to go back outside. S2 added that when C1 gets upset, they often throw themselves to the floor.
The Licensee records video footage of both the inside and outside of the daycare daily. LPA reviewed the video from the day of the incident. The footage showed the Licensee picking up C1 from behind and carrying them into the house. However, LPA did not observe any rough handling of the child, either outside or inside the home. Once inside, the child was seen crying and falling to the ground, but no rough handling was observed by the LPA.
Based upon evidence obtained during this investigation, the allegation that the "Licensee handled the child in a rough manner" is unsubstantiated. A finding that a complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred.
