32 | Per Principal, children in Room 4 and Room 5 are temporarily being provided care in a single classroom. Care is being provided in a single classroom due to repairs and construction currently taking place on, in and around Room 4 and Room 5. Care is being provided in a classroom identified as Room 6. Principal disclosed that Room 4 and Room 5 have a total of 48 children enrolled. Once construction is completed, children will resume care in there assigned classroom.
During staff interviews, S4 disclosed that staff and children have been observed tripping over cots. S4 also disclosed that cots are arranged under tables due to limited space in the classroom for 48 children in care. S6 disclosed that the limited space in the classroom creates a hazard for staff and 48 children to walk through should there be an emergency evacuation. S5 disclosed being worried of falling due to the arrangement of the napping equipment due to the limited space in the classroom for 48 children in care.
During today's investigation, LPA observed 32 children napping in Room 6. LPA observed children napping on cots that were touching each other. (Photos taken) LPA also observed staff stepping over cots while children napped.
Based on the investigation conducted by the LPA which includes interviews, record reviews, and other pertinent information, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
California Code of Regulations, Title 22, Division 12, Chapter 1, 101239.1(d) Napping Equipment is being cited on the attached LIC9099D.
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent.
