32 | Allegation 1: the first allegation stated that unqualified staff was supervising infants. During the investigation, it was revealed that staff are meeting the requirements to be a fully qualified teacher. LPA reviewed complaint documents and no discrepancies were found within the documents that staff do not meet the required education minimums under Title 22 Regulations. After reviewing all the relevant information obtained, there is not a preponderance of the evidence to support the allegation.
Allegation 2: the second allegation stated that facility did not have enough cribs for the sleeping infants. During the investigation, it was revealed that the facility maintains nine cribs and additional cots for older children that are able to climb out of a crib. LPA reviewed relevant complaint materials and no discrepancies were found that staff does not ensure staff there are enough cribs for the sleeping infants. After reviewing all the relevant information obtained, there is not a preponderance of the evidence to support the allegation.
Allegation 3: the third allegation stated that the Director was not present the required minimum time in the facility. During the investigation, it was revealed that the Director or other acting lead were present at the facility. LPA reviewed complaint documents and no discrepancies were found that there was no Director or acting person present the minimum required time stated in Title 22 Regulations. After reviewing all the relevant information obtained, there is not a preponderance of the evidence to support the allegation.
After observations, record reviews, and interviews, it was determined that there was insufficient evidence that the facility was not ensuring staff were qualified to be teachers in the infant classroom, that there were more sleeping infants than cribs; nor that the Director or other acting lead was not present during the required minimum hours. The allegations could not be corroborated with the evidence found during the investigation. Therefore, the allegations have been found unsubstantiated. Although, the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the facility operated in violation of policy in this circumstance.
An exit interview was conducted, and a copy of this report was provided to the Director along with the Notice of Site Visit and Appeal Rights.
