On 08/24/2023, Licensing Program Analyst (LPA) Franchesca White arrived at the above facility for the purpose of an Unannounced Complaint Inspection to deliver findings for the above allegations. LPA announced purpose of inspection and met with Licensee Carolyn Millender, who granted entry to facility. LPA observed 0 children, in care at the time of inspection. All adults present in the home have criminal record clearance.

During this investigation, LPA conducted interviews with the parents of the currently enrolled children, the Licensee, the witness, and conducted record review. During the record review of CalWorks Child Care Provider Payment Request and Child Care Assistance Program Attendance Records dated April 2023, LPA discovered that the week of April 3, 2023, between the hours of 3:00 p.m. – 4:00 p.m. there was a total of 20 children in care consisting of 1 infant, 7 preschool children, and 12 school age children.

 LPA White observed records that reflect 14 children in care on April 6, 2023 between the hours of 5:00 – 6:00 p.m. consisting of 5 preschool children, and 9 school age children. On April 12, 2023 between the hours of 4:00 p.m. – 5:00 p.m., Licensee had a total of 21 kids in care consisting of 8 preschool children, and 11 school age children. Between 2:00 p.m. – 3:00 p.m. on April 18, 2023 there was a total of 18 children documented in care consisting of 7 preschool children and 11 school age children. LPA White observed records to reflect on April 28, 2023 between the hours of 4:00 p.m. – 5:00 p.m. Licensee had a total of 22 children in care consisting of 8 preschool children, and 14 school age children. Facility is licensed for a maximum capacity of 14. The documentation reviewed supports the allegation of the Licensee operating over ratio.

Based on the available information, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Based on information obtained during this investigation, the following Type A deficiency listed on the attached LIC 9099D is being cited in accordance with California Code of Regulations Title 22 Division 12 Chapter 1.

A copy of this report must be provided to the authorized representative of all currently enrolled children and newly enrolled children for the next 12 months (1 year). The report shall be provided, no later than the next business day or the next day that the child is in care.

The Acknowledgement of Receipt of Licensing Reports (LIC 9224) shall be signed and kept in each of the children’s records. During the inspection, LPA provided a copy of the LIC 9224 to the Licensee.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Copies of this report must be posted for 30 days in a visible location for the authorized representatives to the children in care.

Exit interview was conducted with Carolyn Millender. A copy of the report and Appeal Rights was given to Licensee.
