On March 27, 2023 at 9:40AM, Licensing Program Analyst (LPA) Dayna Chambers conducted an unannounced complaint inspection for the purpose of delivering the finding for the above allegation. Upon arrival, LPA met with Katrina Williams, Site Supervisor/Teacher and toured the facility. Upon arrival, there were 6 staff and 24 children in care. During the course of investigating the allegation, LPA conducted confidential interviews with staff and parents, observed center surveillance video from 9:28am to 4:53pm for February 10, 2022, LIC9040 children’s roster for contacting parents, Owie Report dated 02/10/22, child #1 center file documents, and medical summary for child #1. On February 22, 2023, LPA observed the center, conducted interviews, and reviewed surveillance video dated February 10, 2023. The video depicts child #1’s arrival to center at 9:28am with parent, child#1 activities on playground -Friday Free-Play, and child #1’s departure from center with parent at approximately 4:53PM. LPA observed the video with Staff #1. The video depicted two staff members supervising the children on playground. There was one Counselor observing a specific child during the activities. LPA observed approximately 15 children on the playground. LPA observed the time frame when incident occurred on the playground which occurred approximately at 10:34am behind the slide equipment. The

surveillance cameras did not cover the area behind the slide area at the time of incident. After LPA and Staff #1 observed the video together, Staff #1 agreed with LPA, the incident occurred behind the slide area at approximately 10:34am. After LPA observed the video and conducted interviews, there were no witnesses on the playground who observed the incident and staff was unaware there had been an incident on the playground. LPA continued to observe the surveillance video and observed child #1 after naptime. Child #1 was walking to the cubby when staff #1 observed child #1 limping. Per interview, Staff #1 was not sure what happened to cause the limp. Per video and interview, Staff #1 attempted to engage with Child #1 to find out what happened unsuccessfully. When the parent arrived at 4:53pm, the center was unable to provide a reason. The center provided an Owie Report to the parent dated February 10, 2023. Based on the Owie Report, the report stated the center was unaware of how the incident occurred and was not sure the time the incident occurred. On March 6, 2023, LPA obtained from parent: hospital medical record summary for Child #1 dated February 10, 2023 at 7:14PM - Children’s Hospital Los Angeles. The medical records describe the injury as a fractured distal fibula. The “preponderance of the evidence” standard has been met. Based on interviews, observation of surveillance video, record review, and the fact that staff was unable to provide a visual observation of the incident that occurred on 02/10/23, there is a preponderance of the evidence to prove that the facility failed to provide adequate supervision per Title 22 regulations. Therefore, the allegation is substantiated. Deficiency was cited during today's inspection.
Appeal rights were provided and discussed with the facility representative.
A Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.

The program will conduct an in-depth training on the responsibility for providing care and supervision- “visual” supervision with all staff, including the Director for the facility. The center already implemented a change to the playground structure – slide was moved towards the middle of the playground to prevent the obstructed view.

This requirement is not met based on Based on interviews, observation of surveillance video dated 02/10/22, and record reviews, Owie Report dated 02/10/22, medical records, a child sustained an injury at the facility that was not visually observed by any staff which posed a potential health and safety risk to persons in care.

In addition, the center will install an additional surveillance camera. Center staff will watch the CCLD Child Care Center Operator Video: www.ccld.childcarevideos.org
& answer the following questions with staff.

On March 27, 2023 at 9:40AM, Licensing Program Analyst (LPA) Dayna Chambers conducted an unannounced complaint inspection for the purpose of delivering the finding for the above allegation. Upon arrival, there were 6 staff and 24 children in care. During the investigation, LPA Chambers conducted interviews with Staff and Parents, reviewed records, and made observations regarding the above allegations. The complaint alleges that staff members spoke inappropriately to daycare children. Although allegations were made, evidence obtained did not reveal any witnesses or supporting evidence and interviews conducted did not corroborate the allegations. Staff denied observing or making any inappropriately statements to children at any time. LPA interviewed 5 parents out of the 14 parents. The parents interviewed did not disclose any concerns. Parents stated their children have not mentioned any concerns while attending at the center. Based on the information obtained, there is not a preponderance of the evidence to prove that personal rights were violated. The allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred. The allegations are determined to be Unsubstantiated. Appeal rights were provided and discussed with the facility representative. A Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.
