On 8/5/2026 @ 9:00am, Licensing Program Analyst (LPA) Devon Carus conducted a Case Management Unusual Incident inspection to follow up on the self- reported incident that occurred on 7/27/2026 at Valmonte Early Learning Academy located at 3801 Via La Selva. Palos Verdes Estates, CA 90274. The El Segundo Regional Office received the incident report on 7/29/2026. Upon arrival, LPA observed 0 children in care since the school is currently observing summer vacation. All center staff that were present during today’s inspection had fingerprint clearances and are associated to the designated license number.

LPA interviewed the following: Staff #1 (S1)/ Director, and Staff #2 (S2) as the witness. The incident happened towards the beginning of the day during morning outdoor play time at 9:50 am. S2 initially noticed the incident, when checking the attendance and noticing a child was missing after outdoor time was finishing. Child #1 (C1) had returned with her parent within 15 minutes of the incident taking place. Based on the information gathered through interviews, and visual inspection of the playground (site of the incident), it revealed that there were 3 staff/ adults supervising 20 children at that time.

According to the narrative provided by S1 and S2, C1 was on the playground with the other children and headed into the classroom and out to the garden area while the staff were putting the children’s toys away. C1 entered the garden area through an unlocked gate and out of the school through another unlocked gate. According to interviews, these two gates that the child exited through were unlocked on this date since the school was having maintenance done on the outdoor yard, and the custodian in charge of securing these gates had left them unlocked. In result, C1 was able to open these gates and leave the school site on their own.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPA Carus inspected the play area involved in the incident, and observed it to be safe, stable, secure, appropriate for the ages of children enrolled at the pre school, and free of tripping or slipping hazards. LPA Carus did observe that the latches to the gates C1 exited through are within arms reach of a child and pose an immediate health and safety concern if not locked during operating hours.

During today’s visit, the director confirmed that since this incident occurred, the school will have staff check all gates for locks prior to taking the children outside, will be conducting an all staff meeting to discuss that incident, and how to maintain a safer campus, as well as implementing staff positioning on the playground in terms of places to stand, and will be devising a map of all gates that need to be locked on the school grounds in order to ensure the staff lock all gates during operating hours. Furthermore, LPA Carus advised director to inform staff to keep a close eye on children who have a tendency to want to hide or leave the visual range of staff members.

At this time, based on the available information, the preponderance of evidence standard to indicate that a lack of supervision occurred at the pre school has been met.

1 Type-A Violation will be cited today.

LPA Carus informed director, Carolyn Martinez that this report dated 8/5/2026 documents 1 Type-A citation which shall be posted for 30 consecutive days as there is/was an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Carus informed the director to provide a copy of this licensing report dated 8/5/2026 that documents any Type-A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

LPA informed director that the school will need to submit a sign in sheet to the department of the all staff meeting being held to discuss this incident. Additionally, director will submit a depiction of places staff will stand while supervising outdoors, and a copy of the map that will be distributed to staff outlining all gates that need to be locked on school grounds during operating hours. The plan of correction will be due 8/21/2026 since the staff are currently on summer vacation.

This requirement is not met as evidenced by:

Based on interviews and pertinent statements, an enrolled daycare child exited the school site on 7/27/2026 at approximately 9:50am without supervision by a staff member, or parent/guardian. Director, center staff, and licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care.
