Licensing Program Analyst (LPA) Lilia Hernandez conducted an unannounced complaint inspection on 10/03/23 to investigate the above allegation. LPA arrived at the facility at 09:30 AM and met with Margaret Grandeldt, Co-Director, who guided LPA on tour of the facility. There were 15 children and 2 staff present upon arrival.

The purpose of the visit is to deliver findings for the above allegations.

During the investigation LPA obtained a copy of children’s roster, took pictures, conducted interviews and other pertinent information.

Information provided by the reporting party indicates that on 08/3/2023, S1 handled daycare child in a rough manner. Reporting party observed S1 pulling C1 from their shirt.

Per Co-Director, S1 admitted to the incident and stated to Co-Director that they made a mistake while trying to stop C1 from hitting C2.

Per Co-Director, S1 was terminated on 8/4/2023.

While interviewing staff, S1 stated that they indeed pulled on C1 shirt to stop C1 from hitting C2.

Based on the investigation conducted by the Department which includes interviews, record reviews, and other pertinent information, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 101223(a)(3) Personal Rights is being cited on the attached LIC9099D.

The Notice of Site Visit was given and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Exit interview was conducted and report was reviewed with Maggie Grandeldt, Co-Director.

Per Co-Director, on 8/4/2023, S1 was terminated as a plan of correction. Co-Director reviewed personal rights with staff in a meeting on August 25, 2023 as a plan of correction.

Based on interviews conducted, S1 admitted to pulling on C1 shirt in the play yard to prevent child from hitting another child which poses a potential Health or Safety, or Personal Rights risk to persons in care.
