On 7/22/2026, Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced follow up complaint inspection for the purpose of delivering the findings for the above-mentioned allegations. Upon arrival, LPA was greeted and let into the facility by Licensee, HERNANDEZ, SYLVIA J, to whom the reason for the inspection was announced. LPA toured the facility and observed 4 daycare children and 4 staff.

During the course of the investigation, LPA Ornelas made observations, obtained documentation in the form of children’s roster, and conducted interviews with Staff, Parents and children in regard to the above allegations.

-Pertaining to the allegation that - Staff yells at children while in care
According to the Reporting Party (RP), an adult at the day care yells at the children.

According to staff interviewed during the course of the investigation, the home is a smoke free home. One staff member stated that they have a child with asthma. Staff further stated that there are multiple homeless individuals that they have observed walking past the home and have observed in the past smoking from them among other things.

-Pertaining to the allegation that - Facility transports children in vehicles with more children than permitted.
According to the Reporting Party (RP), Staff transport children in vehicles with more children than permitted.

According to children interviewed during the course of the investigation, children that are transported stated that there are never more than 3 other children in the car with them.

According to parents interviewed during the course of the investigation, they have no concerns regarding transportation due to the fact that their children have not disclosed any concerns.

According to staff interviewed during the course of the investigation, they only have a total of 3 children that are being transported currently and a vehicle that fits 6 people

-Pertaining to the allegation that - Facility is not clean nor orderly.
According to the Reporting Party (RP), Facility is not clean nor orderly.

According to parents interviewed during the course of the investigation, parents have never observed the home being not clean or orderly. Parents stated that the home looks like a home with children present and have no concerns.

According to staff interviewed during the course of the investigation, home is cleaned as needed daily. There is staff that are assigned to ensure home is clean and neat.

LPA Ornelas observed home to be neat and clean and staff ensuring that home was orderly while present.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.

According to children interviewed during the course of the investigation, staff at the day care are nice to them. Children further stated that they like the day care and that no one yells at them.

According to parents interviewed during the course of the investigation, parents stated that they have no concerns regarding the manner in which staff speak to the children while at the Family Child Care (FCC). Parents stated that their children like the FCC and have no concerns regarding their children being yelled at. Parents stated that the providers treat their children with respect and their children enjoy attending the day care.

According to staff interviewed during the course of the investigation, children are not yelled at and are spoken to respectfully at all times.

-Pertaining to the allegation that - Staff humiliates children while in care
According to the Reporting Party (RP), staff humiliates children that do not understand instructions.

According to children interviewed during the course of the investigation, staff does not make them feel sad or bad about themselves.

According to parents interviewed during the course of the investigation, staff is kind and respectful. Parents stated that their children like the day care and enjoy going.

According to staff interviewed during the course of the investigation, children are spoken to respectfully and kindly at all times.

-Pertaining to the allegation that - Staff member consumed drugs during work hours, impairing their ability to provide adequate care and supervision, which presents a risk to children/residents/clients in care.
According to the Reporting Party (RP), an individual smokes outside of the day care.

According to children interviewed during the course of the investigation, they have never seen smoke in the home.

According to parents interviewed during the course of the investigation, they have never observed smoke or a smell of smoke inside of the home.
