32 | the playroom. At 9:53 AM, LPA observed eight infants in the playroom with only S2 present. At 10:00 AM, S2 left the playroom, leaving S1 alone with eight infants. At 10:05 AM, S1 left the playroom with one infant to change a diaper in the napping area, leaving S2 alone with seven infants. At 10:23 AM, LPA informed Owner Shirani that seven infants were in the playroom with only S2, which is out of ratio.
This constitutes a Type A violation due to the immediate risk to children’s health and safety.
Based on LPA’s observations, record review, and interviews with relevant parties, it has been determined that:
§ The daycare has mold
§ The daycare is in disrepair
§ The licensee does not ensure the facility is free of pest
§ The licensee is operating out of ratio
The preponderance of evidence standard has been met; therefore, the allegations are SUBSTANTIATED.
Pursuant to Title 22, Division 12, Chapter 1, three (3) deficiencies are cited for violations of Title 22 requirements. These deficiencies are documented on the LIC 809-D.
Upon receipt of this report, the Licensee must post the Notice of Site Visit and any licensing report documenting a Type A deficiency for 30 consecutive days. Failure to maintain required posting will result in an immediate $100 civil penalty. A copy of this report must be provided to all currently enrolled parents/guardians by the next business

Furthermore LPA observed the infant napping room and infant kitchen area to be in disrepair, including: cobwebs, spiders, peeling baseboards, warping walls and flooring, unfinished structural areas, and two clogged sinks, which poses/posed a potential health, safety or personal rights risk to persons in care. | 8
