| Licensee stated a parent requested to come inside of the facility when they dropped off their children. Staff did not let Parent 1 inside and Parent 1 started banging on the door. Staff stated Parent 1 previously came to the daycare to pick up parent 1’s children and was cussing at staff after Staff 1 closed the front door of the facility. Staff were concerned to let Parent 1 inside of the home due to the previous incident that occurred 2 weeks prior. Licensee stated parents have access to the facility upon request.
Licensee stated she confronted Parent 1 to address her concerns about the altercation with the daycare staff. Licensee asked Parent 1 what happened during the verbal altercation with the staff. Licensee stated the parent’s children were the only children present at the time of the discussion with Parent 1. There were no daycare children with the Licensee at the time of the discussion with Parent 1. Staff stated the daycare children were present during the verbal incident that occurred at the facility. The licensee was not present in the home at the time of the verbal altercation with the staff.
Licensee confronted Parent 1 about his behavior at the daycare with the staff. The licensee contacted the police regarding the incident that occurred at the daycare with the staff and Parent 1. Staff stated they did not observe the Licensee behave inappropriately.
Based on evidence received during the investigation which included interviews, records and observations, there is insufficient evidence regarding the allegations of personal rights and refusing entry to facility. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the above alleged violations did or did not occur, therefore the allegations are found to be unsubstantiated. Staff did not give Parent 1 access to the facility due to his inappropriate behavior. Parents have access to the facility. Licensee confronted Parent 1 to address her concerns about the incident between the staff and parent 1. There is insufficient evidence to show that the Licensee’s conduct is a risk to the children in care.
Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided.
