Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced Case Management- Incident follow up inspection on this date to gather additional information due to two (2) incident reports that were reported to the Department on 10/24/2025 and 10/31/2025. Additionally a new incident was reported to the department on 12/01/2025. LPA met with Principal Scarlett Holguin who guided LPA on a tour of the facility. Census was taken.

On October 24th, 2025, an incident was self reported to the Department via Email by the facility who reported that parent shared concerns because they observed their child (child # 1) sitting outdoors wearing no pants and staff was unknown on why child was not wearing pants.



On October 31st, 2025 an incident was self reported to the Department via Email by the facility who reported that staff observed child's # 2 personal rights were violated by a substitute.

On December 1st, 2025 an incident was self reported to the Department via Email by the facility who reported that on 11/20/25 child # 3 fell in the apparatus area requiring medical attention.

All reports were reported within the required 24 hours. The purpose of the inspection was to obtain additional information regarding the incidents reported to the Department.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Regarding the incident reported on 10/24/25- LPA conducted interviews with staff and child # 1. Per interviews with staff there was 4 staff members outside during the incident. Staff # 2 disclosed that incident happened around 4:00 or 4:05 pm they were standing by the apparatus when they noticed another child climbing and not being safe- as they were helping that child they turned and observed child # 1 was sitting down with no pants on. Staff # 2 then proceeded to help child # 1. The four staff outside disclosed that they did not see child # 1 take off their pants and were not sure how long child was with no pants. Per staff # 4 the last time they observed child # 1 was in the house area with Staff # 6 before the areas in the back of the playground were closed at 4 pm. Per Staff # 5 child # 2 spend some time in the water area and recalls them saying "my pants"- staff noticed child # 2 was wearing leggings, but they were not wet. Per Staff # 6 child # 1 was in the house area with them but left between 3:45 and 4:00 pm but not sure what area did child moved to. Staff # 3 disclosed that child # 1 tends to take off their shoes and clothes and are working on reminding child to keep clothes on. LPA determined that child took off their clothes without teacher supervision during transition time of closing the back areas of playground and moving children to the front of the playground which occurred at 4pm. LPA reviewed sign in sheets and observed that child # 1 was signed off at 4:05pm. Child # 1 did not disclosed any information to LPA during interview.

Regarding the incident reported on 10/31/25- LPA conducted interviews with staff- child # 2 is non verbal and not interviewed. Staff # 2 disclosed that they stepped into the classroom when they observed a substitute talking to child # 2 in a rough manner-"like a football coach would talk to their players". Per staff # 3 they heard the substitute using a "loud heavy voice" telling child # 2 to sit down. Per staff # 3 they believed this was the substitute normal voice and it was not done in a malice way. Per staff # 4 they did not observed this incident but recalls informing substitute that child # 2 needed extra support. Additionally, staff # 4 had a concerned on the way this substitute speaks to children as "they would get on their face and recalled a previous incident where this substitute was telling a child "I am the teacher and you are the student."

Regarding the incident reported on 12/1/25- LPA conducted interviews with staff. Per interviews incident was observed. On 11/20/25 Child # 3 was galloping around the apparatus when they tripped on their own falling forward and landing on their arm. First aid was provided- child was asked to move arms and fingers, child was able to move them but showed discomfort and parents were called. Child was picked up and staff advised to take child to the doctor. Facility did not hear back from parent until 12/1 who disclosed that child had fracture arm in two areas and were not planning to bring child back at this time. Per Staff # 1 they asked for a doctors note but have not received one and they are keeping child on roster until they confirm if child will be leaving the program completely.

Based on the LPA’s observations and records reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

A notice of site visit was given and must remain posted for 30 days. Exit Interview

Exit interview conducted and report was reviewed with the facility representative Scarlett Holguin, Principal.
