25 | Licensing Program Analyst (LPAs) Lilia Hernandez and Roberto Luque Avila conducted an unannounced case management inspection on 05/14/2024 for the purpose of addressing an Action Lead Exceedance (ALE) at the facility. LPAs arrived to the facility at 2:40PM and met with NeCole Haywood, Assistant Principal. LPA's did not tour the facility, staff were in a professional development meeting and no children were in care. LPAs were later met with Kandace McLurkin, Interim Principal.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires all licensed Child Care Centers (CCC’s) constructed before January 1,2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five years after the date of the first test.
Community Care Licensing was notified of the Lead Water Testing results conducted at the facility on 10/19/2022. Results were reported to the Department on 02/16/2024. The sample testing was for Outlets "A", "B", and "C" with results above 5.5 ppb which is considered an exceedance. LPAs were not able to verify which outlets were tested because a facility sketch was not provided to the Department prior or during the inspection. Per Assistant Principal, documents were not available at the facility for LPAs to review. Assistant Principal stated that the previous principal may or may not have received the documents for the lead water testing.
Documents pending are External Water Sampler Self-Certification Form (LIC 9275); Child Care Center Sampling Checklist Form (LIC 9276); proof of corrections for Outlets "A", "B" and "C", a copy of water retesting results summary for Outlets "A", "B", "C" and a plan on how often the outlet filter will be serviced.
Based on interviews and supportive documents it has been determined that WEST ATHENS ELEMENTARY SCHOOL CSPP violated Child Care Licensing Regulation Division 12, Chapter 1, Subchapter 5 101700.3 (b)(1) California Lead Action Level at Child Care Centers. ---Page 1 of 2 |
