32 | While investigating the first allegation, LPA observed the facility to be operating in compliance with the staff and student ratio. LPA observed the facility to follow the capacity requirements, during every licensing visit. LPA conducted multiple walk-through inspections and did not observe the facility to be operating out of ratio or over capacity. Based off staff interviews, staff are never left alone with more than 12 children. LPA observed the 2-year-old class to have 2 teachers present. Based on director interview, when a staff member needs to step out or is absent, they step in for support. Per director, they currently have 2 staff secretaries in process of becoming fully qualified to become substitutes, if ever needed.
While investigating the second allegation, LPA conducted multiple visits, and observed adults present at the facility to be working staff. LPA assured all staff present working with children have criminal background record clearance. LPA observed volunteers at the facility reading books to children. While volunteers read books to children, two teachers were present. LPA did not observe any children left alone. Per staff and director interviews, volunteers are either children's parents or students from Tree Academy. Per director, children volunteer to read to preschoolers as an elective course. Based on children interviews, they are familiar with staff who work with them and know teachers names.
LPA reminded the director about student, teacher ratio, and capacity. LPA also reminded the director that children must be supervised at all times and must be with a teacher.
Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
No deficiencies were made today under Title 22 Division 12 of the California Code of Regulations.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with the director, Julie Zaring, including, but not limited to provider Rights, Appeal Procedures and Agencies Consultative Role.
