Licensing Program Analyst (LPA), T. Tran arrived at the above licensed facility to conduct a subsequent complaint inspection for the purpose of concluding a personal rights violation. Upon arrival, LPA met with Site Supervisor, Battina Bray.
Based on the records review and interviews were conducted on 10/21/24, center staff confirmed S1 grabbed C1 by the arm and forcing the child down to pick up the Legos. C1 sustained red finger marks on the forearm. Therefore, the personal rights allegation of facility staff handled a daycare child in a rough manner was substantiated. A finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met.
Facility was cited type A deficiency. Please see Complaint Investigation Report LIC 9099D for deficiency cited. Upon receipt of a Type A deficiency, facility shall post and provide copies of this licensing report to parent/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Personal Rights. Each child shall be free from corporal or unusual punishment, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature.

During the investigation, S1 was immediately removed from the facility. Facility will provide training to all center staff regarding to children's personal right, care and supervision then submit the training materials and staff's attendance to LPA no later than 12/20/24 in order to clear this citation.
