On 2/1/23 at 4pm, Licensing Program Analyst (LPA), V. Wheatley and LPA Adrian Risher conducted an unannounced subsequent complaint inspection regarding the above allegations. LPAs were greeted by licensee Terrence McDuffy. LPAs entered the home and observed 4 children (infants) on the premises with the licensee and his grandmother supervising the children. LPA's requested to interview the school aged children and were informed that the licensee's father Clifford McDuffy, Sr. who is also licensed was out picking up children from school. Licensing Program Manager Maureen Neal spoke to Mr. Clifford McDuffy, and inquired what time he would be in route to the facility and requested to have the children transported directly to the facility.

At approximately 4:30 pm, two school aged children were transported to the facility by licensee Clifford McDuffy and a third child by his wife Mrs. McDuffy. LPA Risher interviewed three school aged children. Based on observations, interviews which were conducted, and information obtained throughout the investigation, the preponderance of evidence has been met. The allegations of personal rights are found to be substantiated. The children were using a porta potty for restroom purposes and not allowed to wash their hands when running water was available.

Personal Rights - Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: To receive safe, healthful, and comfortable accommodations, furnishings, and equipment.

The licensee will cease using a porta potty and allow all children to utilize the bathrooms inside of the home. On today’s inspection the porta potty has been removed off those premises. The licensee & staff have agreed and shall view Personal Rights videos: https://ccld.childcarevideos.org/family-child-care-providers/childrens-personal-rights-in-child-care/. Licensee will submit a written plan of what was viewed and their understanding of personal rights. The plan will be submitted via LIC 855 (declaration form) by 2/8/2023 via email to LPA Wheatley or postal mail.

This requirement was not met as evidenced by the interviews conducted revealed the children were allowed to use a porta potty as a restroom. This is an immediate risk to the health and safety of children in care.

On 11/3/22 at 1:10pm, Licensing Program Analyst (LPA), V. Wheatley conducted an initial unannounced complaint inspection regarding the above allegations. LPA was greeted by licensee Terrence McDuffy who answered the door. LPA observed 5 children total on the premises with the licensee and his grandmother Staff #1 supervising the children. Four of the children are infants and one is three years old. LPA asked for a copy of the roster and the licensee stated he did not have it. Licensee stated his mother who is licensed next door has the files/records. The roster will be provided by the licensee. At this time further investigation was required.

Licensee was informed the parents shall be allowed to view the LIC 9099 reports and to provide LIC 9224 (Acknowledge of Receipt of Licensing Report) to the parents of the enrolled children and newly enrolled children within the next 12 months.

Exit interview. A copy of the report will be provided to the licensee. Appeal rights were provided.

Based on the observations and interviews which were conducted and information obtained, the allegations are found to be unsubstantiated. Unsubstantiated means that the allegations may have happened or is valid. There is not a preponderance of evidence to prove the alleged allegations did or did not occur.
