On 06/10/2026 Licensing Program Analyst (LPA) Lisa Clayton arrived announced at the Malibu Under the Oaks Preschool to conduct a Case Management – Licensee Initiated inspection. The facility was inactive due to the January 2025 Palisades fire.

LPA Clayton met with Administrator Sunshine Armstrong and her father Alan Armstrong. There were no children in care.

The Licensee is requesting to reopen after the Palisades Fire. There was no structural damage to the Child Care Center. The damage was limited to the playground and the surrounding area.

The Facility is licensed to care for 45 preschool children ages 2 to entry into 1st grade, in rooms 2, 3, and 4 only. Hours of operation are Monday through Friday, 7:30 am to 5:30pm.

A Fire Safety clearance was granted by inspector F. Modugno of the LA County Fire Department Prevention Bureau Calabasas Office on 06/05/2026.

The following was observed of the:

INDOOR ACTIVITY SPACE

Fire extinguishers were 2AB10C or larger.

Smoke detectors were observed in operable condition based on the Fire inspection conducted by the LA County fire department prevention department.

First aid kits were available with the required essentials: scissors, bandages, tweezers, ointments, manuals and thermometer.

Age-appropriate furniture and equipment was observed in good repair. LPA observed age-appropriate books and toys for preschool children.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Cots were observed for napping. Director was reminded that bedding must be removed and stored separately when cots are stacked. Cots were observed in good condition.

Cubbies were observed for children’s belongings in each classroom.

Drinking water will be provided through filtered water faucets.

Windows were in good repair free of chipping paint, dirt, insects, or debris.

Adequate lighting was observed.

LPA observed trash cans used for solid waste with tight-fitting lids.

Disinfectants, cleaning solutions, toxins or other poisons were observed inaccessible to children in care.

Classroom #4 will be used for isolation of ill children. Sunshine agreed that there will be a cot or mat, readily available for ill children and that these children must be under direct visual supervision at all times.

The facility was equipped with a working telephone and LPA Clayton confirmed the phone number is 310-456-7111. The classrooms central air and heating.

The classrooms were clean in good repair.

Parents and authorized adults will sign children in and out. Admin Sunshine was reminded that sign-in sheets must be maintained for a minimum of 30 days and readily available for review at the request of the department or its representative.

FOOD SERVICE:

The facility provided snacks and water. Parents/authorized representatives provide lunch.

Admin. Sunshine stated that refrigerator is scheduled to be delivered today and set up in classroom #2 (the Golden Poppy Classroom) LPA Clayton asked Sunshine to send photos of the refrigerator, she agreed. LPA Clayton inspected the food storage area, and observed it to be free of litter, rodents or vermin. Toxins or chemicals were stored separately.

RESTROOMS

There is a “Jack and Jill” restroom for children’s use only, between classroom 1 and 4 with one (1) sink and one (1) toilet. LPA Clayton reminded Admin. Sunshine that the door allowing access to classroom #1 has to remain locked, making classroom inaccessible to children in care.

The children’s restroom is located at the front entrance of the school, and has 2 sinks, and 3 toilets available for children’s use only.

The restrooms were clean and sanitized with the necessary toiletries, sinks and toilets were operable and in good repair. Faucets delivered cold water. Changing tables were within reach of a sink, padding surfaces were at least one inch thick, covered with washable vinyl or plastic, with raised sides at least three inches high.

Sunshine was informed there shall be a written toilet-training plan for children being toilet trained per Title 22, section 101428 - Infant Care Personal Services

OUTDOOR ACTIVITY SPACE

Age-appropriate toys and equipment were observed in good condition.

The outdoor activity space was enclosed with a 4 foot or higher gate.

Grass and adequate cushioning under play structures was observed. Water will be made readily available outdoors using filtered water pitchers and children use their personal water bottles for drinking.

LPA observed adequate shading and benches for resting.

LPA did not observe any bodies of water on the school property during today’s inspection. Director was informed that all standing water should be removed immediately after each use.

Based on today’s inspection, the following corrections are required prior to reopening:

· Secure the gate surrounding the water shut-off equipment, making it inaccessible to children in care


· Lock and close off the gap in the gate leading to the creek, making it inaccessible to children in care
· Install Carbon monoxide detector
· Remove wood planks from the enclosed garden area
· Cover/cushion the metal and wood tree supports (two)
· Padlock on the gate leading to the maintenance supply area

LPA Clayton advised Admin. Sunshine to not use the wooden swing attached to the oak tree until the structure is inspected by a licensed inspector. LPA Clayton provided Admin. Sunshine with an inspector’s contact information. She agreed and acknowledged understanding.

The following closing statements were discussed with Administrator Sunshine:

Admin. Sunshine was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations and/or Health and Safety Codes, no Deficiencies or Technical Violations were cited.

An exit interview was conducted, the report was reviewed and provided to Admin. Sunshine.
